The Ministry of Finance proposes to amend 3 Laws related to specialized management

Accordingly, the recommendations of the Ministry of Finance are carried out on the basis of requirements of reforming administrative procedures under Resolution 19-2016/NQ-CP, Resolution 35/NQ-CP and the Prime Minister’s Decision No. 2026/QD-TTg in 2015.

In the report, the Ministry of Finance has proposed specific recommendations of the amendment of the 3 Laws. The proposed amendment and supplement of the Laws is implemented on the principle: For exported goods, specialized inspections are carried out only at the request of the importers or the buyers or the sellers.

On the basis of risk management, Customs will assess whether enterprises well observe the law or not, in order to implement classification appropriately. In addition, Customs also changes specialized inspections from the Customs clearance period to post-clearance period.

Besides, Customs needs to apply international rules in specialized inspections with the following content: Mutual Recognition; acknowledgement of the quality certification for goods imported from developed countries or famous brands in the world.

Customs should conduct inspections and recognize the quality of goods at the stage of production (from the producers or the foreign importers) , before goods are put into circulation.

In order to implement the above principles uniformly, the Ministry of Finance has proposed that the amendment of the Law which is submitted to the Prime Minister must include the following contents: the orders and Customs procedures for inspections, the rate of inspections, the application of risk management, inspection exemption, acknowledgement of the quality certification, and the handling of administrative violations, etc.
