32 customs brokers ended operation

VCN- The General Department of Vietnam Customs (GDVC) has issued Decision 1528/QD-TCHQ ending the operation of customs brokers and revoking all codes of customs broker staff for 32 customs brokers under the management of Hai Phong Customs Department.

Earlier, many customs brokers were suspended from operation because they did not meet prescribed conditions, but after six years they did not overcome and failed to send written request for continuous operation to the GDVC.

Therefore, the GDVC’s decision for ending operation for 32 customs brokers and their staff complies with provisions at Item a.4, Point a, Clause 2, Article 7 of Circular 12/ 2015/TT-BTC amended and supplemented in Clause 5 Article 1 of Circular 22/2019/TT-BTC of the Ministry of Finance and revocation of the code of customs broker staff as prescribed in Point dd Article 10 of Circular 12/2015/TT-BTC amended and supplemented in Clause 7 Article 1 of Circular 22/2019/TT-BTC.

This decision takes effect from June 8, 2020 and abolishes the decisions of the GDVC’s Director General on the certification of these customs brokers.

The list of ended 32 customs brokers is in the attached file.

According to Clause 5 Article 1 of Circular 22/2019/TT-BTC, customs brokers are terminated from operation in the following cases:

“a.1) Being sanctioned for acts of smuggling, illegally transporting goods and currencies across border gates; production and trade of banned goods; tax evasion resulting in criminal prosecution.

a.2) Committing fraud in providing application for recognition of customs brokers or application for issuing codes of customs broker’s staff to Customs authorities.

a.3) Using documents not provided by goods owners to carry out customs procedures for export or import of goods;

a.4) Beyond six months from the date of suspension as prescribed in Item a.1, Item a.2 and Item a.3, Point a, Clause 1 of this Article, Customs Brokers do not overcome and submit a written request for continous operation to the GDVC;

a.5) Beyond six months from the date of suspension of operation for cases in Item 1 of this article but customs broker does not send application for reoperation.

a.6) Customs brokers are dissolved or bankrupted in accordance with the Law on Enterprises and the Law on Bankruptcy;

a.7) Customs brokers send application for termination of operation."
