Thanh Cong Vietnam Auto Joint Stock Company raised problems related to the provisions of Circular 11/2022/TT-BKHCN dated August 10, 2022 of the Ministry of Science and Technology on the removal of calculating methods of the automobile localization ratio.
The company said that the abolition of regulations on the discrete level of imported auto parts will create a legal loophole, and will not encourage automakers to invest in domestic automobile assembly factories, machinery and equipment, as well as in supporting industries. The abolition will also make the automakers reduce production stages due to the import of large monolithic semi-finished components, leading to cutting the labor force, and negatively affecting social development.
Accordingly, the company proposes to supplement regulations on the discrete level of imported auto parts into decrees or issue specific instructions, creating a legal framework to attract automakers in production and investment in machinery and equipment. Because of the maintaining of the regulations on a discrete level, the makers continue to enjoy preferential tax rates and tax refunds as per Decree 125/2017/ND-CP and Decree 101/2021/ND-CP.
Regarding the implementation of the provisions of Decree 101/2021/ND-CP, the company proposes to supplement the instruction of application of tax incentives under the Prime Minister’s Decision 229/QD-TTg dated February 4, 2016, avoiding inconsistencies.
Hai Vuong Co., Ltd., a company operating in the area managed by Khanh Hoa Customs Department, said that under Article 3 of the National Technical Safety Regulation on electric safety ACVN 01-2008/BLDTBXH, Customs only approves the declaration of imported empty CO gas cylinders when the import is registered with the Department of Labor, Invalids and Social Affairs.
However, the Department of Labor, Invalids and Social Affairs is not in charge of verifying the empty CO gas cylinders. The company must register the import at a verification center under the Department, causing difficulties, and raising costs and time for businesses. Therefore, the company proposed that Customs should guide the registration at the department's verification center.
Tong Hong Tannery Vietnam Joint Stock Company raised a question about how to determine "foreign traders absent in Vietnam" as per provisions of Clause 5, Article 3 of the Law on Foreign Trade Management due to the lack of information and data.
Therefore, the company proposed Customs guide or develop support tools to search and identify "foreign traders absent in Vietnam".
