Respecting the legal basis

Resolution No. 19 / NQ-CP of the Government in 2014, 2015, 2016 and 2017 poses the need to promote perfecting the socialist-oriented market economy to ensure synchronous and modern on the basis of full compliance with the rules of market economy and international economic integration, the focus is to develop, amend and supplement the law, mechanisms, policies, creating the business environment smooth and equal. With the aim of maximizing the export and import activities of the business community, minimizing the time and costs of carrying out customs procedures, Customs has always respected the legal basis and at the same time efforts to implement the reform and modernization in all aspects and achieved positive results.

According to the Legal Department, in three years (from 2014 to 2016), Customs has focused drastically on the implementation, review and proposal of the customs legislation system in the reform and modernization plan of 2016-2020; at the same time, annually reviewing and proposing the Ministry of Finance to promulgate a program on elaboration and legal documents on customs. During the process of drafting the document, the customs sector has designed the regulations to targets the objectives stated in Resolutions 19 / NQ-CP as well as the Customs Modernization and Reform Strategy.

Statistics show that, over the past 3 years, the General Department of Customs has drafted and submitted 2 decrees, 1 resolution of the National Assembly, 8 decrees, 5 decisions of the Prime Minister, 39 circulars, Joint Circular. Of which, the Customs Law of 2014 was promulgated, and a detailed legal document guiding the implementation of the Law has created a legal basis for the implementation of the Customs Development Strategy to 2020. In the picture, in 2016, Customs has participated in the development of export, import tax law (passed by the National Assembly), creating the legal basis for deepening international integration, encouraging production development, promoting export and reasonable protection, conditional, selective, suitable for the process of integration, simple and convenient for taxpayers.

With the assigned responsibilities in facilitating import-export enterprises, the customs sector has actively coordinated and pushed up the expansion of the national single window mechanism with 11/14 ministries and branches, 37 procedures, over 260,975 dossiers and 9,355 enterprises participated.

In addition, the Customs sector also attaches importance to issuing many professional procedures and regulations; To attach importance to the review, examination, systematization, consolidation, monitoring and evaluation of the implementation of the system of legal documents on customs, thus contributing to the improvement of the customs legislation.

In order to improve the effectiveness of the specialized inspection, the customs sector has also presided over and coordinated with the specialized management departments to expand the centralized establishment of specialized inspection at border gate for import-export goods, up to now, there have been 10 specialized inspection places located in 8 customs areas; Implementing 37 procedures related to specialized and industrial management activities on the National Portal.

Representatives of Legal Department of General Department of Vietnam Customs said that some regulations on specialized inspection have received much support from the business community such as regulations on labeling energy after clearance, abolished Examination of the content of formaldehyde and aromatic amino acids converted from azo dyes in textile products ... Besides, it is impossible not to mention the list of goods subject to specialized inspection with the transparency of goods names and HS codes has created favorable conditions for customs and enterprises in the process of implementation. Specifically, the list of goods subject to food safety inspection by the Ministry of Industry and Commerce; List of goods subject to plant quarantine, Animal quarantine, fishery quarantine of Ministry of Agriculture and Rural Development.

Effort to accompany the enterprises

Meet the demand of the business community, while keeping abreast of the objectives, requirements and tasks set out in the Government's resolutions, stepping up the reform of administrative procedures, the Customs sector continues to focus on shortening the time of cross-border clearance of goods, with the target by 2020, the time of goods clearance across borders will be less than 36 hours for export goods, 41 hours for import goods.

According to representatives of the Legal Department, in 2017, the customs sector registered 15 projects submitted to the Government, the Prime Minister, and the National Assembly; 14 projects submitted to the Ministry of Finance; 75 projects of General Department. Of which, in the second quarter of 2017, registration completed 4 projects submitted to the Government; 10 projects submitted to the Ministry; 26 projects, central work of the General Department of Customs.

In order to continue reviewing the problems and shortcomings of mechanisms, policies, legal documents, processes and regulations for elaboration of plans for amendment, supplementation or replacement, the General Department of Customs shall focus on finalizing the draft for submission to the Government for promulgation of the Decree amending and supplementing the Government's Decree No. 08/2015 / ND-CP of January 21 of 2015 detailing and implementing measures for the Customs procedure, customs clearance, inspection, supervision, customs control; submitting to the Ministry of Finance the Circular amending and supplementing of Circular No. 38/2015 / TT-BTC dated March 25 of 2015 and the Circular on inspection and determination of origin of export and import goods of the Ministry of Finance; Circular guiding customs procedures, customs inspection and supervision according to the Decree amending and supplementing of the Government's Decree No. 08/2015 / ND-CP; Circular guiding Decree No. 68/2016 / ND-CP dated on 1 July 2016 of the Government on the conditions for business in duty-free shops, warehouses, storing yards, location of customs procedures, customs supervision, and inspection; building and modifying the processing of customs procedures to ensure management; Recommend to ministries and sectors to amend and supplement policies in line with reality in order to increase revenues and improve the efficiency of state management of export and import goods.

To achieve this progress, representatives of the Legal Department said that the Customs sector will focus on 4 main groups of solutions. That is, completing the system of legal documents guiding customs law, export-import tax law; Improving the efficiency of the work of specialized inspection; completing mechanism of National Single Window, ASEAN Single Window; Implementing measures to improve the efficiency of customs management, promoting the application of information technology, the implement effectively customs operation measures, extend the provision of online public services to serve the efficiency of administrative procedures for people and enterprises.
