Customs enhances examination and inspections of construction glass

According to the Customs force, in recent times, there have been many incidents involving some enterprises importing goods declared as white glass with outsourcing sharp edge, new 100%, made in China, HS code: 7006.00.90 with a tax rate of 30% (C/O form E shall enjoy preferential tax rate of 0%) and goods imported in international ports but registered at Customs Branches in Vietnam.
However, through the physical inspections of goods, the Customs force has discovered that these goods were white glass, not outsourcing sharp edge, new 100%, made in China and were not identified to be covered with a steaming layer, HS code of 7005 with a tax rate of 35% or 40% (do not enjoy special preferential tax rate), with the actual imported amount more than the number declared on Customs declarations for commercial fraud and tax evasion.
In order to prevent these violations, the Customs Surveillance and Management Department under the General Department of Vietnam Customs has requested Customs Departments of provinces and cities to strengthen physical inspections and control of imported construction glass declared as white glass, outsourcing sharp edge, made in China with HS code: 7006.99.90, especially for combined transport declarations and independent transport declarations.
Currently, the management of the quality of imported construction glass is implemented in accordance with the provisions of the Ministry of Construction’s Circular 11/2009/TT-BXD.
Earlier, the Customs force had discovered commercial fraud in the declaration of imported construction glass for tax evasion. The Customs Branch of Sai Gon port, Zone 1 has recently discovered a typical violated case. Accordingly, N.K.S. Production Trading Company Limited (at District 8, Ho Chi Minh City) declared to conduct import procedures through Cat Lai port a shipment of construction glass. According to Customs declarations, the shipment contained nearly 8,000 m2 of optical glass, used for gas stoves, made in China, worth more than 574 million vnd. This enterprises presented C/O form E to enjoy the preferential tax rate of 0%.

Through physical inspections, the Customs force detected that imported goods were imported floating glass plates, with no brand, worth more than 1 billion vnd with a import tax rate of 40%. The Customs force has determined that the total amount of tax payable to the State budget for the shipment is nearly 500 million vnd.
