According to the notice of the Express Cargo Customs Branch (Hanoi Customs Department) sent to the business community and the express service firms: From 14 February, 2017, the Branch has not implemented Customs procedures for declarations for the type of temporary imported goods for re-export and temporary exported goods for re-import; and has concurrently requested the business community and the courier service firms to implement Customs procedures for the above type at the Border Customs Branches.

Previously, the Express Cargo Customs Branch (the Ho Chi Minh City Customs) also informed businesses that the Branch would not implement Customs procedures for the type of temporary imported goods for re-export and temporary exported goods for re-import from 15 December, 2016.

As representatives of the Hanoi Express Cargo Customs Branch Hanoi advised, the Branch does not perform Customs procedures for the type of temporary imported goods for re-export and temporary exported goods for re-import in compliance with the provisions in the Decree No. 08//2015/ ND CP providing specific regulations and measures to implement the Customs Law on Customs procedures, Inspections and supervisions.

Earlier, the Customs Supervision and Management Department also sent a dispatch to Ho Chi Minh City Customs requesting the implementation of Customs procedures for temporary imported goods for re-export and temporary exported goods for re-import in line with regulations on venue for completing Customs procedures in Articles 49, 50, 51, 52, 53, 54 and 55 of the Government Decree No. 88/2015/ND-CP.

However, the right implementation of the above regulations has not facilitated enterprises. On 15 February, 2017, Ha Noi Customs sent a written request to the General Department of Customs on removing obstacles on Customs procedures for temporary imported goods for re-export and temporary exported goods for re-import at the Express Cargo Customs Branch

According to Hanoi Customs, based on the regulations in the Articles 49, 50, 51, 52, 53, 54 and 55 of the Government Decree No. 88/2015/ND-CP providing specific regulations and measures to implement the Law Customs on Customs procedures, inspections and supervisions, Customs procedures for temporary imported goods for re-export and temporary exported goods for re-import are implemented at the border gate Customs Branches. Accordingly, all stages of Customs operations for temporary imported goods for re-export and temporary exported goods for re-import must be done at the border from the stage of reception, registration, document examination and goods inspection as defined in paragraph 1 of Article 22 of the Customs Law.

Thus, temporary imported goods for re-export and temporary exported goods for re-import sent via airline express services are not permitted to be transported to warehouses of courier service firms (outside the gate areas), and must be processed at the Customs Branch at Noi Bai international airport gate.

However, there are quite a lot of demands on sending temporary imported goods for re-export and temporary exported goods via express services, forbidding the Express Cargo Customs Branches implementing Customs procedures for this type will cause congestion in express operations and raise costs for enterprises (goods sent via Express services must be transported on the whole pallet to the warehouse of the Express companies to handle)

For the above reasons, the Hanoi Customs Department proposed the General Department of Customs to issue measures to facilitate enterprises sending goods through the express services. Currently, the headquarters of the Express Cargo Customs Branch under the Hanoi Customs Department is located in Noi Bai International Airport, so Hanoi Customs suggested the General Department of Customs propose that the Ministry of Finance recognize the Express Cargo Customs Branch as a border gate Customs Branch.
