The General Department of Vietnam Customs (GDVC) has proposed to amend Decision 15/2017/QD-TTg to facilitate import and export activities

Mr. Au Anh Tuan, Acting Director of Customs Control and Supervision Department (GDVC) stated that after 6 months of implementation, the GDVC planned to assess and summarize the implementation of Decision 15 to consider, amend, supplement and report the Ministry of Finance and the Prime Minister for handling.

According to the Government’s Decision 15/2017/QD-TTg dated 12th May 2017 promulgating the list of imported goods required to follow Customs procedures at entry border gate, taking effect from July 1, 2017, the goods in this list includes: Imported goods with high risk of Tax management need to be controlled strictly(including commodities subject to Special Consumption Tax, Safeguard Tariff and Anti-dumping Duty); Goods with risk and required for specialized management such as goods subject to animal quarantine, aquatic quarantine or phytosanitary; Explosive substances, explosives; Goods affecting security and defense; Goods affecting the environment such as scrap.

After 4 months of implementation, the Government’s Decision 15/2017/QD-TTg has met the targets of reducing the trade deficit and strictly controlling high-risk commodities affecting the environment, security, defense and public health.

During the implementation, the GDVC received complaints about obstacles of local Customs units and businesses, mainly Customs procedure point for commodities under the list of goods required to follow Customs procedures at entry border gate; Goods are materials for direct manufacture; Scraps which are domestically sold by processing businesses; Goods are sent via postal and express service; Goods with the destination of ICD on bill of lading

Currently, the Ministry of Finance and the GDVC have guided to remove obstacles. The obstacles and proposals related Customs procedures at ICDs and Investment/Processing Customs Branches have been not processed, because these points are outside border gates Customs procedure points, the commodities specified in Decision 15/2017/QD-TTg are not allowed to carry out Customs procedures at these points.

Goods with the destination of ICD shown on the Bill of lading, the Ministry of Finance reported to the Prime Minister and guided local Customs units and businesses that the procedures of Customs branch transfer will not be carried out at ICDs for goods under the list regulated in Article 1 Decision 15/2017/QD-TTg with the destination of ICD shown on the Bill of lading (except for My Dinh ICD, Phuoc Long ICD).

Mr. Tuan said that after 6 months of implementation, the GDVC planned to assess and summarize the implementation of Decision 15 to consider, amend, supplement and report the Ministry of Finance and the Prime Minister for handling toward shortening the list of goods required to follow Customs procedures at border gate to focus on commodity groups which need to be really strictly controlled and inconsistent to carry out Customs procedures at outside border gates in each period.

The Customs branch transfer to ICDs will be permitted if meeting the requirements on infrastructure, facilities, Customs supervision, and management of specialized agencies.

According to regulations of Customs Law, there are no limitations on Customs procedure points. In order to meet requirements on management and control of imported goods in each period (to restrict trade deficit and strictly control high-risk commodities affecting the environment, security, defense and public health, Decree 08/2015/ND-CP stipulates that the Prime Minister is assigned to promulgate the list of imported goods required to follow Customs procedures at entry border gate.
