Review and complete the Draft Circular amending, supplementing Circular 38 and 39

The seminar was attended by representatives of Customs Departments of relevant provinces and cities such as Ho Chi Minh City, Dong Nai, Binh Duong, Ba Ria - Vung Tau, Da Nang, An Giang, Can Tho, Long An, Binh Phuoc and Tay Ninh.
Speaking at the opening of the seminar, Deputy Director General of Vietnam Customs Mai Xuan Thanh said that previously the senior leaders contributed ideas to the General Department and the Drafting Board. Now, through this seminar, the units would have a chance to present their opinions more carefully and in depth to complete the draft circular. At the same time, through the review to build the circular, it would facilitate businesses and help to reduce the clearance time for businesses, building the Customs-Business relationship, as well as review unnecessary procedures and inadequacies that exist in the implementation process in order to make management more effective.
Accordingly, at the workshop, the delegates focused on discussing and reviewing the contents in three groups of issues, including those related to the field of common customs procedures; those related to the field of automatic supervision at seaports, warehouses and locations; and those on tax and tax management.

Specifically, at the seminar, the representative of Dong Nai Customs Department commented on the additional declaration after cargo clearance in the case of sending inadequate documents, according to the draft, the regulations on enterprise procedures, when implementing additional declaration, it must have two contents: image recorded from the process of quantity checking and the responsibility of the customs authorities is conducting physical inspection of goods in the bonded warehouse. The reason is that in the implementation process, not all companies have installed cameras in the warehouse and most businesses do not detect shortage after receiving stock but only when they are put into production so it is very difficult. At the time of detecting missing goods, there are no cameras for recording. Therefore, it is recommended to revise this clause in the Draft Circular.
Besides that, a number of shortcomings related to management work as a basis for identifying exported goods into bonded warehouses, cancelling duplicate declarations, handling tax violations after finalization report and supervising destruction of raw materials using for export processing and production, were also mentioned by the Customs Departments of Dong Nai, Binh Duong, Tay Ninh and Binh Phuoc.
At the seminar, representatives of Ho Chi Minh City Customs Department also contributed ideas related to the content of on-site export which is facing difficulties in management, resulting in many declarations on the system. Accordingly, the unit proposed a way to manage on-the-spot exports, which should have its own type of management. In contrast, there are tasks that arise at the request of enterprises such as packing CFSs for export goods. The draft circular has not supplemented this point.
In addition, many said that it should not make a quota for finalization report of priority enterprises, causing difficulties for the customs authorities and not appropriate in accordance with Circular 72/2015/TT-BTC stipulating on goods in priority; change the purpose of using materials of the AEO; one-time permits on a national single window portal are also facing difficulties.
