At the conference, representatives of Phu My Port border gate Sub-department representatives disseminated the regulations on Customs management for bonded warehouse business and export processing enterprises and also answered questions of Enterprises involving in this field. In which focusing on conditions to be recognized as a bonded warehouse in accordance with the new regulations, and Law compliance of bonded warehouses’ owners in the storage of goods, and regulations on sanctions against bonded warehouse and export processing enterprises management.

Specifically, for regulations on conditions and procedures to be recognized as a bonded warehouse, according to the regulations of Phu My Port border gate Customs sub-department, most bonded warehouses in the province were established before Decree 68/2016/NĐ-CP dated July 01, 2016, so they have not met all conditions under the new regulations. As proposed by the Phu My Port border gate Sub-Department, in order to ensure the continuous operation of the bonded warehouses without interruption, bonded warehouse business enterprises must supplement the infrastructure and management system to meet the current regulations.

So, enterprises must have software which meets the criteria on: imported goods, exported goods and inventories in bonded warehouses by each item, purchasers and Customs declarations; Meeting requirements for storage and retrieval of data for making statistical reports, and directly connected to Customs agencies. Besides, the bonded warehouses must have a camera system to monitor 24/24 in all areas in the bonded warehouses by each item. The camera data must be stored for at least 12 months. And the Camera system must be directly connected with Customs agencies.

In fact, the compliance with the provisions of the law of the bonded warehouse business and export processing enterprises is not high and is still late, and is not in accordance with regulations, and the coordination between enterprises and Customs agencies still has many shortcomings which need resolving.

Typically, the activities of relocation, maintenance and reinforcement of goods in bonded warehouses often take place but goods owners or bonded warehouse owners do not inform the Customs office in documents before implementation; the storage of goods does not conform to the lease contract, and goods are stored beyond the recognized area of bonded warehouses; Goods are stored in bonded warehouses unscientifically and not according to each warehouse lease owner, each item, declaration and location; The transport of goods in and out of warehouses and outside leased yards outside of export processing enterprises does not comply with the supervision and management mechanism registered with Customs .

In order to overcome these shortcomings, the Phu My Port border gate Sub-Department proposed that before implementing the relocation, maintenance and reinforcement of goods in the bonded warehouses, goods owners or warehouses’ owners must inform Customs agencies. In addition, well ensuring the connection of the surveillance camera system and the management software of goods in and out the bonded warehouses and management and storage of goods in the bonded warehouses, which ensures that the goods in and out the warehouses are right with quantity, objects and in accordance with warehouse lease contract under the law.

It is recommended that bonded warehouse business and export processing enterprises need to update and understand clearly current regulations and contact Customs agencies to be guided in the implementation of activities relating to the bonded warehouse business and export processing enterprises.
