Electronic tax payment: Customs will support business to make payment documents

According to current provisions in Circular No.184/2015/TT-BTC, guiding on the procedures for the declaration and guarantee of taxes, tax collection and payment, delayed payment, fines, charges, fees, and other revenues for imported/exported or transited goods and means of transport, which stipulates that taxpayers can declare payment via e-transaction channel of the banks by internet anywhere and anytime and taxpayers must not pay at the bank officers. In case the taxpayers use electronic general guarantee, they will take the initiative in implementing Customs procedures and completing their Tax obligations by tax amount guarantees anytime and anywhere, excluding days off and public holidays.

However, over the past time, obstacles arise when some provinces, cities and some banks implemented the Tax collection and payment via banks under Circular 184/2015/TT-BTC, were due to the transmission and system errors and information inaccurately updated by banks and enterprises.

Therefore, in order to further facilitate taxpayers to limit errors at the stage of declaration, Ms. Nguyen Thi Thanh Huong, Deputy Head of the Estimation and Budget Management Division under the Import-Export Duty Department (General Department of Vietnam Customs) said, instead enterprises should make the payment documents at commercial banks and banks have to search enterprises’ information on the Customs system as the current time, the enterprises will directly declare and make payment document on the system of Customs authorities at the Customs Electronic Information Portal. Accordingly, the Customs authorities instead of waiting for information from bank systems, they will directly receive information from the business and transfer the payment information of enterprises to banks.

Besides, the General Department of Vietnam Customs also proposes to the State Treasury that the budget items need to be identified and made by Customs and directly transferred to the Treasury instead of being made by the Banks as current time.

According to Ms. Huong analysis, implementing the above direction, the taxpayers' declaration information will be accurate because it was made from the original database of Customs and the Commercial banks and reduce information update steps and minimize and handle errors and obstacles in querying data on Customs declarations of taxpayers, which have not been updated or updated incorrectly or wrongly compared with information queried at the Information Portal from the General Department of Vietnam Customs. At the same time, facilitating enterprises in the current electronic tax payment process and further reducing the tax payment time.

Currently, to implement this regulation, the Import-Export Duty Department and the Customs IT and Statistics Department are building the infrastructure, as well as supplementing the legal basis for proposal to amend and supplement Circular 184/2015/TT-BTC. According to the plan, by August 2017, the regulations on direct payment at the Customs e-Payment Portal (24hours/7days) will be implemented by the General Department of Vietnam Customs.

Currently, cooperation agreements on import and export duty collection through electronic mode have been signed with 33 banks by the General Department of Vietnam Customs, with revenues account for 90% to 92% of the total State budget revenues of Customs. According to feedback from commercial banks, business communities and Customs of provinces and cities, regulations on tax payment under Circular 184 have facilitated taxpayers in simplifying administrative procedures, minimizing the time for implementation Customs procedures, especially the Customs clearance time when receiving information on paid taxes, and reducing incurred expense for businesses. In addition, taxpayers do not have to write information which is difficult to identify on the payment receipts such as State budget account code, collection agency code, treasury code (this information will be defined by the collection agencies and State management agencies), so that errors are limited.

In addition, the implementation of tax payment in accordance with Circular 184/2015/TT-BTC has shortened the transfer time from the State Treasury to Customs, and quickly reduced debt for enterprises, and reduces the storage time, goods clearance time, and minimizes incurred expenses. At the same time, the coordination between Customs and Commercial banks is getting better, so the obstacles and errors of tax payment account are quickly handled.

The electronic tax payment has been implemented by Customs since 2010, followed by the issuance of the Ministry of Finance's Circular No.126/2014/TT-BTC dated August 28, 2014, creating favorable conditions for enterprises in paying taxes and simplifying administrative procedures and reducing Customs clearance time and reducing time and expenses for Customs and businesses that do not incur tax debts after businesses paid taxes. At that time, the State budget revenue through banks accounted for about 63.5% of total Customs’ revenues.

In order to continue reforming administrative procedures in collecting State budget revenues, the General Department of Vietnam Customs submitted to the Ministry of Finance Circular No.184/2015/TT-BTC to replace Circular No.126/2014/ TT-BTC in accordance with the revised Customs Law on online declarations implementation and electronic tax payment. With advantages such as: Taxpayers can stay at home or anywhere and declare Tax payment through the electronic transaction channel of banks at anytime, the tax payers using electronic general guarantee will take the initiative in implementing Customs procedures and completing their Tax obligations by tax amount guarantees at anytime and anywhere, excluding days off and public holidays of banks, and the collection of charges and fees of ministries and sectors are allowed to be implemented through the National Single Window.
