Import complete products but declare components
The Investigation Police Agency of Ho Chi Minh City Public Security is expanding the investigation of a case that Sa Huynh Trading and Production Company Ltd imported thousands of ASANZO-branded ovens from China but declared they were components. The case was discovered by Ho Chi Minh City Customs Department and transferred to the Investigation Police Agency.
According to the case file, in September 2018, Sa Huynh company opened an import declaration of a shipment as components of glass oven, including a plastic cover, glass bowl, oven timer which are 100% new and made in China with a value of more than VND212 million.
Detecting suspicions, in September 2018, the Customs Enforcement Team under Ho Chi Minh City Customs Department issued a decision on inspection and coordinated with the Customs Branch at Saigon Port Border Gate Zone 4 to inspect the shipment. As a result, the Customs Department found 1,300 completed ASANZO-branded ovens which are disassembled, 100% new without origin.
According to the leader of the Customs Enforcement Team, the above imported goods are in complete form subject to state quality inspection. However, the company declared as components to avoid state quality inspection.
After the shipment was discovered and seized by Ho Chi Minh City Customs, Sa company has sent a written explanation with a reason that its partner sent the wrong products. When the customs agency invited the company’s representative to work with, the director of this company did not come and authorized Nguyen The Tai to work with the customs. However, Tai said he was a customs broker and did not know anything about the shipment.

The importer is a bogus enterprise
Sa Huynh Trading and Production Company Ltd was licensed by the Ho Chi Minh City Department of Planning and Investment for establishment in July 2018 and has registered business address at 861/27/39 Tran Xuan Soan Street, District 7, Ho Chi Minh City. The legal representative is Huynh Thi Sa Quol.
After discovering violations, the Customs Enforcement Team has expanded the investigation, verification and discovered that this company is a "bogus" enterprise and is established to illegally import goods. Specifically, the registered business address does not exist, the company’s director Huynh Thi Sa Quol does not registered permanent residence at the locality.
Further investigating the director according to the information on the Certificate of Enterprise Establishment issued by the Ho Chi Minh City Department of Planning and Investment, the Customs Enforcement Team discovered many unexpected circumstances. Huynh Thi Sa Quol confirmed the information on the business registration certificate of Sa Huynh Production and Trading Co., Ltd but she said that she is a worker, resides in Soc Trang and has never done procedures to establish an enterprise. She is not the director of Sa Huynh Trading Production Company Limited and did not sign any documents relating to this company and did not authorize Nguyen The Tai to work with the Customs. She affirmed that someone used her personal information to establish the company and forged her signature for illegal business.
Returning to the declarations by Nguyen The Tai, he declared that he did not know anything related to the imports of Sa Huynh company. A few days later, Tai and a man named Truong Ngoc Liem went back to work with the Customs Department and said that his previous declarations were not correct, and now he wants to re-declare that Truong Ngoc Liem was the person who gave all the documents of the shipment to Tai for customs clearance. Also, Liem said that he contributed capital with his close friend to establish Sa Huynh Trading and Production Co., Ltd specializing in household goods. Due to not agreeing on the name of the founder, Liem and his friend hired Huynh Thi Sa Quol to be the company’s representative. When the shipment was discovered by Customs, Liem asked Quol to work with the Customs, but she disagreed, so he made procedures to change the legal representative which is Truong Ngoc Liem, born in 1982, residing in Ho Chi Minh City. Liem acknowledged that the signatures on documents naming Mrs. Huynh Thi Sa Quot were forged.

Accordingly, Ho Chi Minh City Customs Department affirmed that those who established Sa Huynh Trading and Production Co., Ltd had acts of false declarations and fake records to import goods, which are signs of "smuggling", so the case has been transferred to the Police-Investigation Police Agency of Ho Chi Minh City Public Security for further investigation.
