First time holding a symposium

Deputy Director of Ho Chi Minh City Customs Department Nguyen Huu Nghiep said that through working sessions and dialogue conferences, Ho Chi Minh City Customs Department has met and discussed with shipping lines, shipping agents but this is the first time, the unit organizes thematic dialogue conference with shipping lines and shipping agents.

According to Mr. Nguyen Huu Nghiep, in the past, especially in the years of the Covid-19 pandemic, there was a time when fuel prices were high, but shipping lines still arranged import and export goods smoothly.

In 2023, following the direction of the Ministry of Finance, the General Department of Customs, the Ho Chi Minh City Customs Department continues to implement many solutions to support businesses, including shipping lines, and shipping agents.

At this symposium, the Ho Chi Minh City Customs Department spent a lot of time discussing and instructing shipping lines and shipping agents on the regulations implemented in practice, and at the same time paying attention to many related contents of transporting import and export goods, declaring the manifest of shipping lines through the national single-window system; regulations on import and transportation of scrap; transporting hazardous waste; transporting hazardous waste across borders, etc.

At the same time, sharing and exchanging problematic contents for the two sides to accompany in implementation, creating the most favorable conditions for shipping lines, and shipping agents.

Mr. Vuong Tuan Nam, Head of Supervision and Control Department - Ho Chi Minh City Customs Department said, from the perspective of the Customs agency, the coordination with shipping lines and shipping agents is very good, such as declarations on the electronic system; handling backlogged goods at the request of the customs authority.

Telling businesses about the status of manifest declaration, Deputy Director of the Saigon port area 3 Customs Branch Le Chien Thang gave a lot of information on specific regulations on amending and supplementing ship documents. In recent years, the implementation of this regulation has faced many obstacles and has not met the practical requirements of enterprises.

“In the past, some businesses want to hide the identity of the shipper, so they want to change the name of the shipper. However, according to regulations, the law only allows to change of the name of the consignee and the port of discharge and does not stipulate the change of the name of the consignor, so the Customs authority refuses in these cases,” Mr. Le Chien Thang noted.

Set up a mailbox to receive business documents

At the conference, enterprises' problems focused on the content of declaration, amendment and supplementation of the dossiers of ships on exit.

Some businesses believe that the additional declaration of digital information for exporting and importing ships, and enterprises with electronic records on the national single-window system, however, the decree stipulates that documents must be submitted to prove and explain the documents.

Meanwhile, Khanh Hoi port is in the process of converting functions, protecting the port from allowing businesses to drive into the port, causing businesses to walk a long distance from the port gate to the workplace of the port supervision Customs, making businesses spend a lot of time and costs for submitting paper documents.

Answering enterprises' problems, the declaration of amendments and supplements to the dossiers of ships on exit shall be made according to Article 67 of Decree 08 and Decree 59. Accordingly, the cargo declaration: Declaration of amendments within 24 hours from the time ships exit; Other dossiers: Revised declaration before the time ships exit; submit to the customs office the documents explaining and proving.

The Customs authorities noted that these decrees do not specify documents to prove and explain; do not specify the form of submission. The National Single Window does not have the function of attaching documents to prove the amended declaration. It is recommended that the shipping line submit documents proving the amended declaration in person or by post.

Sharing and noting the problems arising from shipping lines, and shipping agents, Deputy Director General Nguyen Huu Nghiep said that Customs authorities and businesses strictly implement the content of the decree in the spirit of law compliance.

Enterprises' problems must be solved, in the immediate future, the Customs Supervision and Control Department shall coordinate with the Saigon port area 3 Customs Sub-Department to consider and receive the enterprise's explanation documents via email to Customs.

At the same time, Ho Chi Minh City Customs Department acknowledges the opinions of shipping lines and will propose the General Department of Customs upgrade the Single Window System or the online public service system to allow the submission of documents proving the revised declaration on the system. In the long run, with the problems in the decree, businesses and Customs together make recommendations to amend and supplement accordingly.

At the conference, leaders of Ho Chi Minh City Customs Department exchanged and provided guidance on handling backlogged goods for shipping lines, shipping agents, etc.
