Strengthening control of rice imports and exports and preventing risk of origin fraud

VCN – In order to prevent origin fraud and illegal goods labeling and transshipment for rice products (with HS codes 1006.20, 1006.30 and 1006.40.90) imported and then exported or re-exported to other markets, the General Department of Vietnam Customs (GDVC) has requested local customs departments to strictly inspect and supervise the item.

Regarding the conditions for rice import, the GDVC cites Circular 11/2021/TT-BNNPTNT dated September 20, 2021 of the Ministry of Agriculture and Rural Development as saying that rice products (HS codes 1006.20, 1006.30 and 1006.40.90) are subject to plant quarantine and food safety inspection upon import.

For exported rice, the country’s top customs regulator requests local customs departments to follow the Government Decree 107/2018/ND-CP dated August 15, 2018 as saying that if the Vietnamese trader meets conditions specified in Article 4 of this Decree and is granted a certificate of eligibility for rice export will be allowed to export rice; the trader that only exports organic rice, parboiled rice or bio-fortified rice is not required to meet the business conditions specified in Points a and b, Clause 1, and Clause 2 of this Article, and is not required to be granted the certificate.

The GDVC also requires local customs units to inspect and identify the origin for rice products with HS codes 1006.20, 1006.30 and 1006.40.90 in accordance with regulations on the determination of origin for imports and exports prescribed in Circular 38/2018/TT-BTC dated April 20, 2018 of the Ministry of Finance (amended and supplemented at Circular 62/2019/TT-BTC dated September 5, 2019), Decision 4286/QD-TCHQ dated December 31, 2015 and Official Letter 5189/TCHQ-GSQL dated August 13, 2019 and related documents.

For shipments classified in the inspection channel, customs officers must check the labeling in line with Decree 111/2021/ND-CP dated December 9, 2021 amending and supplementing a number of articles of the Government's Decree 43/2017/ND-CP dated April 14, 2017.

Customs officers must conduct the physical inspection for rice shipments (HS codes 1006.20, 1006.30 and 1006.40.90) exported under regime B13 (export of imported goods).

During the inspection, if the customs detects violations of businesses, it must handle them. Customs will coordinate with other competent forces such as the Police, Border Guard, and Market Surveillance to investigate and identify signs of origin fraud or illicit transshipment.

In addition, Customs units must strengthen information collection, review rice export and import activities in the area; assess and analyze information to identify risks and high-risk businesses on origin fraud or illicit transshipment. Collaborate and share information with relevant professional units to conduct inspections in customs clearance, post-clearance audit, and anti-smuggling.
