Revising regulations on management of means of road and waterway transport

Adding regulations on declaring goods information in advance

According to the General Department of Customs, the management of transport by road, inland waterway and other means of transport has raised problems and inadequacies. Customs procedures for railway, road and inland waterway vehicles on entry and exit must be done through the National Single Window.

Regarding the advance information about imported goods, although the Customs Law stipulates advanced declaration, Decree 08/2015/ND- CP has not specified this content. Therefore, traders abuse this regulation to perform smuggling and trade fraud, but the management agency at the border gate has no basis to handle violations.

Existing provisions are not clear for vehicle entering through land but exiting through sea, and vehicles entering via air and sea but exiting via land, so many problems have arisen, especially for foreign vehicles participating in traffic in Vietnam according.

To remove problems and expand administrative procedure reform, in the draft decree, Articles 74 and 75 will be amended towards adding regulations on submitting documents for vehicles for the first entry or exit to the National Single Window and abolishing Article 76 as the content has been included in Articles 74 and 75.

The draft also adds specific regulations and guidelines on providing information of imported goods before they enter Vietnam's territory to meet requirements of management and adds regulations on vehicles mortgaged at credit institutions or rented by financial companies. The driver is allowed to present a valid copy of the vehicle registration certificate and the confirmation letter issued by the credit institution or the financial company.

Additional regulations must be in line with reality

The draft decree also adds regulations for vehicles entering or exiting through the land border gate and then exiting by rail, sea or air or vice versa and adds regulations on inspection and supervision of rudimentary vehicles traveling crossing the border and operating in border gate areas.

The draft decree amends the name of the type of border gate and means of inland waterway transport in compliance with provisions of law and gives guidelines for using forms for inland water vehicles on entry and exit; guide online declaration and online processing for inland waterway vehicles on entry and exit via the National Single Window Portal.

Article 81 of the draft decree also adds the phrase "border gate" to ensure these vehicles are only allowed to pass through the border gate described in the law, and are not allowed to cross the border area if the border area is not a border gate, and adds regulations on the responsibilities of drivers for running the vehicles carrying imported goods to designated gathering places, supervision area or inspection area at the border gate to wait for customs clearance; and responsibilities of the customs authority in carrying out customs supervision and inspection of vehicles crossing the border.

In addition, the draft decree amends and supplements regulations on customs procedures for means of transport on exit, entry and in transit based on the contents prescribed in Decree 85/2019 and based on the information technology application that all procedures are processed on the National Single Window Portal.
