Recognizing problems related to Decree 128

Through the consultation conference, Vung Tau port border gateCustoms Branch expects to recognize problems, proposals and recommendations of shipping lines and shipping agents on mechanisms, policies and administrative procedures related to the customs sector to promptly deal with and facilitate the operation of shipping lines and shipping agents.
Thereby, strengthening the partnership between the customs agency, specialized agencies,shipping lines and shipping agents; helping the Vung Tau port border gate Customs Branch,shipping lines and shipping agents to understand, trust and support each other in handling customs issues.
Speaking at the conference, Deputy Director of Ba Ria - Vung Tau Customs Department Bui Sy Duc said that the reform of administrative procedures has been placed as a top priority. The department is also in the leading group of Ba Ria - Vung Tau province in administrative procedure reform.

Deputy Director Bui Sy Duc acknowledged that the above results were thanks to listening to comments from enterprises to promptly remove problems. In that spirit, the Ba Ria - Vung Tau Customs Department expects to continue to receive frank commentsto promptly solveshortcomings affecting the operation of enterprises.
At the conference, many shipping lines raised problems about the provisions of Decree 128/2020 / ND-CP dated October 19, 2020 on sanctioning of administrative violations in the field of Customs. Specifically, Decree 128 stipulates that enterprises are fined from VND5 - 10 million for inaccurate declarations of the number of master bills of lading, the number of house bills of lading on the cargo manifest of documents of means of transport on entry, exit and in transit; and inaccurate declaration of the quantity ofluggage on the luggage declaration of documents of means of transport on entry, exit, and in transit. According to shipping lines, this requirement is not possible because the shipping lines cannot accurately control the above data to meet the requirements of the decree.
Regarding this problem Vung Tau port border gate Customs Branch said that the problem will be noted and reported to ahigher level for handling.

Some shipping lines also asked about immigration procedures for foreign ships entering Vi Sai inland water port.
Accordingly, the representative of Vung Tau Port port border gate Customs Branch said that according to Decision 2942 / QD-BGTVT, Vi Sai port is a floating dock, which can receive foreign ships for repair but not for goods delivery. However, because Vi Sai port does not connect with the national single-window system, the shipping lines cannot carry out electronic customs procedures. To be able to carry out electronic customs procedures, Vi Sai port needs to contact the competent authority to be issued with a port code on the national singlewindow system.

In addition, at the conference, Vung Tau port border gate Customs Branch also removed many problems for shipping lines related to the import of scrap, additional declaration procedures on the Manifest system and declaration of empty containers.
