Hundreds of BMW cars “dry in the sun” at VICT

VCN – After nearly 9 months, 355 cars of BMW brand are still being held in custody at Vietnam International container terminals (VICT) at district 7, HCMC. Those cars are the exhibits of the case of cheating in importing cars of Euro auto Corp that was prosecuted by Anti-smuggling and Investigation Department – General Department of Vietnam Customs.

As mentioned above, the number of cars were imported to VICT by the end of 2016 by the Euro auto Corp but it was suspended by customs authorities due to some violations of this company.

Earlier, at the end of 8/2017, the Euro auto Corp sent a document to Saigon port area 3 Customs Branch to ask for putting 355 BMW cars in storage in order to avoid damage due to storage in the outdoor of VICT. However, those cars are exhibits of the case that investigated by the Investigation Police Agency thus it is not within the jurisdiction of the Customs authority.

After nearly 9 months, 355 cars of BMW brand still being held in custody at Vietnam International container terminals (VICT) at district 7, HCMC. Those cars are the exhibits of the case of cheating in importing cars of Euro auto Corp that was prosecuted by Anti-smuggling and Investigation Department – General Department of Vietnam Customs.

Based on the finding, the above cars were imported by Euro auto Corp to VICT by the end of 2016, but it has been suspended from customs clearance due to some violations of this company.

In that, 133 cars have done customs procedures but have not been cleared yet; the remaining of 222 cars have not done customs clearance.

As Customs News informed, on 20/12/2016, the Anti-smuggling and Investigation Department - General Department of Vietnam Customs issued Decision No. 18 / QD-DTCBL to prosecute smuggling cases occurred at Euro auto Corp. The decision is based on the results of the investigation, verification and collecting evidence and after consultation with the People's Procuracy of Vietnam about the importation of all types of BMW cars that violated to Customs laws of Euro auto Corp.

Earlier, on 30/11/2016, the Ministry of Finance has issued express dispatch No.17041 / BTC-VP to the General Department of Vietnam Customs on the prevention of smuggling and trade frauds in the import of cars.

In this dispatch, the Ministry of Finance clearly stated that: Through the management, inspection and examination of the prevention and anti-smuggling and trade frauds on the import of completed automobiles of Euro auto Corp (tax code: 0304791427, address: 808 Nguyen Van Linh street, Tan Phu Ward, District 7, Ho Chi Minh City) had identified three major violations.

That is: The company arbitrarily consumed goods (imported BMW cars) during the preservation time in order to wait for completion of customs clearance according to regulations.

The company intentionally did not provide the certificate of origin (C/O) and dossiers, vouchers, documents of BMW cars imported by the Company that has signs of deceiving customers.

The company uses fake documents such as sales contracts, commercial invoices ... to import BMW cars.
