Hanoi Customs: Already recognised over 100 places of inspection in factories and at construction sites

Deputy Head of the Division of Customs Supervision and Control (Hanoi Customs Department) Doan Manh Hai said that the recognition of inspection places at factories and construction sites will facilitate enterprises in carrying out physical inspection of goods, reducing inspection time.

However, not all businesses and any kind of goods can be recognized by the Customs authorities to be inspected at such locations. The place of inspection at construction sites or factories is only applicable to place for gathering and conducting physical inspection of imported machinery, equipment, raw materials, components and supplies for factory constructions, implementing investment projects, serving the production or exports of enterprises within the validity of recognition decisions.

Besides facilitating enterprises to be recognized by the customs authorities as the inspection site at the factory and the construction site, according to Mr. Hai, the regulations should be supplemented to meet the customs inspection requirements. Hanoi Customs Department has also proposed this issue in the draft circular amending and supplementing Circular 38/2015/TT-BTC and Circular 39/2018/TT-BTC.

Accordingly, in the application file for recognizing the location of the enterprise, it is necessary to supplement papers proving the right to use the location (certificate of land use right or contract of land use right); supplementing regulations on conditions to meet the requirements of customs inspection and supervision such as equipping surveillance cameras.

In addition, the Hanoi Customs Department also proposed to extend the time to implement the order and procedures for deciding the location recognition. The reason is that the time limit of 5 working days is not enough to carry out the order and procedures for issuing decision to recognize places, including: examining dossiers, conducting an on-site inspection of warehouses and yards, requesting the General Department of Vietnam Customs to grant location codes and promulgate the recognition decision.

Article 102 of Circular 38/2015/TT-BTC stipulated on places for goods inspection at the construction site or factories as follows:

Inspection place is place where imported machinery, equipment, raw materials, components and supplies are gathered for building factory, work and implementing investment projects, serving production of goods or exported goods.

Regarding the order of establishment, the enterprise should submit a paper request for recognition of the inspection place at the construction site, manufacture and factory, enclosed with the design map of the inspection area to the Customs Department where the construction, manufacture and factory is built.

Within 5 working days after receiving a complete dossier of the enterprise, the Customs Department should: check dossiers, conduct an on-site inspection of warehouses and yards and issue a decision to recognize it; the recognition decision is valid for two years from the date of issue. Upon expiry, if the enterprise sent a paper request document for extension, the Customs Department would examine and consider extending the validity of the decision, within no more than two years from the date of issuance.

In case the place of inspection does not meet the requirements of customs inspection, Customs authority must issue a document in response to the enterprise.

Enterprises are responsible for arranging premises and vehicles for inspection at the construction site or manufacturer and may only put goods into production, construction or installation after being cleared by customs authorities.

After completing the construction, installation or manufacture and factories that are no longer needed to request to conduct physical inspection of export and import goods at these locations by customs authorities, enterprises must send paper request to the customs authority for terminating the operation of these places.
