Problems of enterprises as matters solved by the Customs

Director of Ha Nam Ninh Customs Department Nguyen Thu Nhieu said that amid the general economic situation and import-export activities, the business operation of enterprises has plunged. The department has strictly implemented provisions and the roles and responsibilities of the head; proactively reviewed and inspected internally; promptly prevented and detected shortcomings in direction, administration and public duty performance.

"Especially, the department has strengthened administrative reform, customs modernization and I.T. application in customs operation to facilitate enterprises, " said the Director.

The business community has highly appreciated the effective support of the department's leader through meeting and organizing dialogue conferences with the businesses.

Mr Nguyen Manh Duc, the representative of Van Loi Garment Company, said that Ha Nam Ninh Customs Department practically listened to and accompanied businesses. When the business community reflected on problems, Customs quickly responded and provided solutions to remove the problems.

According to a representative of YoungOne Nam Dinh Co., Ltd., - an FDI company, the company has faced limitations in accessing policies and legal regulations. Understanding these problems, Ha Nam Ninh Customs Department and Nam Dinh Customs Department assigned officers to contact directly to help the company understand the regulations, policies and laws and resolve the difficulties when carrying out procedures.

According to assessments from enterprises, the department's plan to develop a Customs-Business partnership in 2023 has been executed effectively, which is expected to speed up the customs clearance and promptly support enterprises' production and business activities.

To promote the efficiency of the Customs-Business partnership under five goals set by the General Department of Vietnam Customs, the department has supported enterprises in accessing new customs regulations, import and export activities, and trade trends; answered problems arising in the customs process.

Especially the department always arranges a working team at the headquarters of the department and branches to perform as the focal point to instruct enterprises.

For the target of improving the quality of dialogue and promptly removing difficulties and obstacles for businesses, Ha Nam Ninh Customs Department sets a request to answer questions during the customs process at the branches within 2 working hours; strengthen 24/7 online dialogue with businesses at branch and department levels.

On June 20, Ha Nam Ninh Customs Department held a dialogue conference with more than 300 enterprises engaged in business, production and import of goods in the three provinces of Ninh Binh, Ha Nam and Nam Dinh. At this conference, the department's leader directly answered the problem of ILJIN DIAMOND VINA Co., Ltd. related to the error of the surveillance camera of goods in and out of the warehouse of the export processing enterprise (the camera is installed under Decree 18/2021/ND-CP).

To understand regulations for this matter, the leader cites Point 2.3, Clause 2, Section 1 issued together with Decision 247/QD-TCHQ dated March 2, 2022, of the GDVC as saying that when the error related to the surveillance camera system occurs, the export processing enterprises must notify the Customs to agree on a monitoring plan while waiting for overcoming the error as per Appendix 2 "Notification of incidents" issued together with Decision 247. The export processing enterprises must repair and replace equipment within a maximum of 10 (ten) working days to restore system operation.

If, beyond the time limit, the export processing enterprise has not completed the restoration of the system, it must send a written notice of the specific reasons and estimated completion time to the Customs authority. For surveillance cameras at the gate in and out of the export processing enterprise, during the interruption of recording camera images due to an incident, the enterprise must make a monitoring book, record the number of vehicles and containers (if any), the time to enter/exit the export processing enterprise and submit it to the Customs upon request.

Regarding the problem of Bao Linh Joint Stock Company related to the process of implementing processing contracts with foreign traders, the company often has many processing contract appendices, while there are only five boxes of permit code on the declaration.

The representative of Ha Nam Ninh Customs Department said that on May 27, 2021, the GDVC issued Official Letter No. 2535/TCHQ-GSQL saying that if the enterprise imports and exports goods under the processing contract appendix, it must declare the processing contract receipt number and the processing contract appendix number at the section of import and export permit. If the number of processing contract appendices exceeds the allowed quantity stated in the section on import and export permits, the receipt number of the processing contract appendix will be declared in the notes section.

Van Loi Co., Ltd. also raised problems when sending goods for reprocessing, but the company did not provide timely information about the processing contract to the Customs and sent the goods for reprocessing.

According to a representative of Ha Nam Ninh Customs Department, Point b, Clause 2, Article 10 of Decree No. 134/2016/ND-CP amended and supplemented in Clause 4, Article 1 of Decree 18/2021/ND-CP stipulates that if the taxpayer does not notify reprocessing establishments or reprocessing contracts to the Customs as prescribed by the customs law, they will be sanctioned for administrative violations. The Customs still exempts tax for goods imported for processing if the goods meet conditions specified in Article 10 of Decree 134/2016/ND-CP as amended and supplemented in Clause 4, Article 1 of Decree 18/2021/ND-CP. This regulation applies to processing contracts arising since April 25, 2021 (the effective date of Decree 18/2021/ND-CP).
