Enterprise takes responsibility with the use purpose of imported goods

VCN – This was the content in the guidance of General Department of Vietnam Customs sent to provincial customs department in the process of carrying out customs procedures for goods subject to quality inspection of imported feedstuff and aquafeed.

Accordingly, the General Department of Vietnam Customs recommended that the units should base on the guidance of the Plant Protection Department in Document No. 01/BVTC-TH dated January 2, 2020 about checking quality of imported feedstuffs and aquafeeds and the guidance of the Directorate of Fisheries in Official Letter 176/TCTS-PCTTr dated February 6, 2020 on checking quality of imported raw material of aquafeed for implementation.

Specifically, for feedstuffs originating from plant, it must be subject from State inspection about quality of imported goods; for raw materials of aquafeeds imported in the period from January 1, 2020 to the effective date of the Circular promulgating the National Technical Regulation on raw materials for aquafeeds production, it would be subject from State inspection on quality. Enterprises should declare and take responsibility for the use of imported goods.

Earlier, Ba Ria-Vung Tau Customs Department had raised problems in the process of receiving two import dossiers of imported aquafeed material. Specifically, on January 10, 2020, Khai Anh Co., Ltd., Binh Thuan registered the import declaration of goods with item’s name of wheat (raw materials for producing aquafeed). On February 3, 2020, Thang Long Biological Technology Co., Ltd registered the import declaration of goods with item names of wheat which was raw material for producing aquafeeds.

Both of the above declarations have been registered for phytosanitary, but the enterprises did not register for state quality inspection on the grounds that the quarantine agency did not receive them (there is a certification of exemption from quality inspection from the Region II Plan Quarantine Sub-Department).

According to Document No. 01/BVTV-TH dated January 2, 2020 of the Plant Protection Department - the Ministry of Agriculture and Rural Development sent to the Regional Plant Quarantine Sub-Departments about guidance on checking the quality of imported feedstuffs and aquafeeds. Accordingly, it "did not receive dossiers and carry out inspection for aquafeeds originating from plant due to ineligible for inclusion in the List of goods subject to specialized inspection before clearance."

Thus, with the same imported item as wheat but there were two different management methods. For declarations declared as "raw materials for production of feedstuffs," enterprises should register for state inspection on quality. On the other hand, for declarations of "raw materials using for aquafeeds production," it did not need to register from State inspecton on quality.
