Customs notifies classification results for export finger joint laminated panels

GDVC responds to businesses classification of Finger Joint Laminated Panels |
On August 13, 2020, the General Department of Customs issued Notice No. 5344 / TB-TCHQ on classification results for import and export goods after reviewing proposals of concerned enterprises, associations, ministries and agencies.
Accordingly, under the proposal of the Ministry of Agriculture and Rural Development in Official Dispatch No. 5078 / BNN-TCLN dated July 31, 2020 on applying HS code to exported finger joint laminated; the proposal of Department of Tax Policy - Ministry of Finance on the classification and application of tax rates on wooden plates; the analysis results of the Customs Verification Agency and the additional documents of Moc Cat TuongJoint Stock Company, the General Department of Customs officially notifies the classification results for this item as follows:

Rubber Wood Finger Joint Laminated Panels, 44mm thick x 1100mm wide x 4500mm long # & VN registered customs declaration by Moc Cat Tuong joinery Joint Stock Company, located in Trang Dai Ward, Bien Hoa and Dong Nai at the Bien Hoa Customs Branch (Dong Nai Customs Department) on July 23, 2018 are rubber wood products in sheets which have been planed, sanded, (44 x 1100 x 4500) mm and end-jointed.
These sheets cannot be used immediately, and must be further processed to make flooring, table tops and stairs depending on the purpose of use (according to the production process of MocCat TuongJoint Stock Company Rubber, a finished wood panel have spent14 manufacturing stages and can be used for each specific purpose).
Based on the production process, the General Department of Customs said this item did not have enough foundations for exclusion of heading 44.07 and not enough foundations for classification into heading 44.18 as proposed by the association and the company.
However, in order to avoid disturbances in production, business and export activities, the General Department of Customs agreed to classify this item into heading 44.18 as “Builders’ joinery and carpentry of wood, including cellular wood panels, assembled parquet panels, shingles and shakes”, sub-heading “other”, sub-heading 4418.99” other”, HS 4418.99.90 “other” in the Vietnam Export and Import Classification Nomenclature.
As a result, given by the result of this notice, exported finger joint laminated panels are entitled to a 0% tax rate.

Notice 5344/ TB-TCHQ dated August 13, 2020 will replace the Notice No. 4250 / TB-TCHQ dated June 24, 2020 on classification results for import and export goods.
