Consulting enterprises to amend Circular 38 and 39

At the workshop, Deputy Director General of the General Department of Vietnam Customs Mai Xuan Thanh said the Circular covers most of the basic operational process. However, following the policy of transparency, simplification, facilitation and saving cost for enterprises under the direction of the Government and Prime Minister, the Deputy Director hopes that enterprises will give feedback and raise actual problems for the Drafting Board to understand and remove shortcomings after the legal document is promulgated.

“The participation of more than 180 businesses, exceeding the initial expectation, shows the interest of the business community in amending and supplementing Circular 38/2015/TT-BTC stipulating customs procedures, customs inspection and supervision; import and export duty and tax management for imports and exports, and Circular 39/2018/TT-BTC amending Circular 38/2015/TT-BTC”, said Deputy Director General Mai Xuan Thanh.

Director of USAID Trade Facilitation Project, Claudio Dordi, said that Circulars 38 and 39 are two key legal frameworks in instructing the Law on Customs. However, after a period of implementation, some problems need to be revised, so the amendment of these circulars is significant in customs modernization, reform, and facilitation of customs clearance. Mr Claudio Dordi hoped that the two revised circulars would simplify procedures and facilitate trade because simplifying customs procedures play an essential role in boosting economic and trade growth.

At the workshop, representatives of the technical department informed about key revised content groups such as customs procedures; management for processed and manufactured goods for export; supervision for imports and exports took in and out ports, warehouses, yards and sites; customs value; tax collection, payment and management; tax-exempt entitles, notification of tax-exempt lists, tax-exempt procedures; post-clearance audit; authorized economic operator.

The representatives of enterprises gave comments to the Drafting Board. Deputy Director General Mai Xuan Thanh said that the Customs authority would carefully consider problems raised by businesses and transparently handle them.

On October 19, the General Department of Vietnam Customs and the USAID Trade Facilitation Project will jointly hold a workshop.
