Completing operational process on management for export processing and manufacturing goods under digital customs model

At the workshop, representatives of Customs units focused on discussing the amendment and supplementation of regulations on management for on-spot exports and imports.
Director of Customs Control and Supervision Department Au Anh Tuan said that the GDVC has developed operational processes to perform the digital and smart customs models, including solutions on export processing and manufacturing activities and export processing enterprises.
Through seminars, the GDVC has recognized the opinions of experts and local Customs departments, and basically completed the operational processes.
The GDVC submitted to the Ministry of Finance for signing and promulgating a Decree amending Decree 08/2015/ND-CP and replacing Decree 59/2018/ND-CP.
Some regulations related to the management for the regime of export processing and production are revised. Many ministries and sectors have given feedback.
The Ministry of Industry and Trade has commented on the regime of on-spot export and import specified in Article 35 of Decree 08/2015/ND-CP.
“The Ministry of Industry and Trade said that the regime is inconsistent with the export and import of goods, because there is no goods transportation from abroad into Vietnam or from Vietnam to the other country or from the customs control area to the country, so there is no import-export activity," said Tuan.
Accordingly, the representatives agreed that it is necessary to consider the trade of goods between a Vietnamese enterprise and a foreign trader who is not present in Vietnam and is designated by the foreign trader to deliver and receive the goods with other enterprises in Vietnam are domestic trading activities and not subject to Customs control.
The management of this regime has created a great burden for Customs. Especially, a large number of on-spot export declarations are waiting at many local customs departments, but there is no corresponding import declaration.
However, the representatives also said that this will have some impacts on businesses, so a specific impact assessment is needed. Accordingly, the representatives of Customs units provided solutions to ensure the benefits of enterprises when amending this regulation.
The workshop discussed amending and supplementing regulations on checking the final settlement report on the import - export - inventory of imported raw materials, supplies, and exported products of the regime of export processing and manufacturing and export processing enterprises.
The representative of the Customs Control and Supervision Department also introduced operational requirements between enterprises and Customs authorities on the information of export processing and production under the digital customs model, requirements for the final settlement report of import - export - inventory of export processing and producing goods under the digital customs model. At the same time, collecting opinions on amendments and supplements to legal regulations and management plans for these goods.
