Amending function, mission and organisational structure of Customs Branches of Goods Verification

The new decision of the General Department of Vietnam Customs amending and supplementing Clause 1, Article 1 as follows: “The Customs Branches of Goods Verification 2, 3, 4, 5, 6 and the southeast region are called as Customs Branch of Goods Verification) is a unit under the Customs Department of Goods Verification that advises and assists the Director of the Customs Department of Goods Verification and directly conducts the inspection, analysis, classification, assessment and quality inspection, food safety inspection for export and import goods within the management area assigned by the Director of the Customs Department of Goods Verification.

“To amend and supplement Clause 2, Article 2 as follows: “2. Organise the inspection, analysis, classification, assessment, quality control and food safety inspection of exported and imported goods in the area as assigned by the Director of the Customs Department of Goods Verification.”

Clause 3, Article 2 is amended in the direction that the Customs Branch of Goods Verification under the Customs Department of Goods Verification has the missions and authorities to issue the notification of analysis results attaching with the commodity code, notification of analysis results with the recommended code number, notification of inspection results and notification of results of quality inspection and food safety inspection.

The affiliated Customs Branch of Goods Verification will handle complaints, denunciations and problems related to the results after conducting the inspection, analysis, classification, assessment and quality inspection, and food safety inspection for export and import goods under the management of Customs Department of Goods Verification in accordance with law (amended and supplemented in Clause 5, Article 2).

The decision of the General Department of Vietnam Customs also amends and supplements Points a and c, Clause 7, Article 2. The Customs Branch of Goods Verification builds, amends and supplements legal and guidance documents, professional inspection on analysis, classification, assessment and quality inspection, as well as food safety inspection for exported and imported goods under the management of the Customs Customs Department of Goods Verification.

At the same time, inspecting implementation of regulations and procedures on inspection, analysis, classification, assessment, quality inspection and food safety inspection for export and import goods, for customs unit under the management of the Customs Department of Goods Verification and as assigned by the Director of the Customs Department of Goods Verification.

The decision of the General Department of Vietnam Customs takes effect from June 7, 2021. Contents specified in Decision 2556/QD-TCHQ dated August 15, 2016 stipulating the functions, missions, powers and organisational structure of Customs Branches of Goods Verification under the Customs Department of Goods Verification are not contrary to this decision that remains in place.

Regarding this issue, in the provisions of Circular No. 17/2021/TT-BTC amending and supplementing Circular No. 14/2015/TT-BTC of the Ministry of Finance, there were many new regulations on the order and analytical procedures to classify exported and imported goods.

For example, the authority for signing and issuing a notification of classification results is signed and promulgated by the Director of Customs Department of Goods Verification.

For each item sent for analysis, it should make a request for the analysis of exported and imported goods which is considered as a sampling record.

The request dossier must contain a technical document. If technical documents are not available, the unit requesting analysis will specify the reason for the absence of technical documents in item 12 of the request for analysis.

Customs authorities where a request arises should send the sample in person or by post to reduce direct contact.

Along with amending and supplementing the functions, missions, powers and organisational structure of Customs Branches of Goods Verification under the Customs Department of Goods Verification, the General Department of Vietnam Customs also issued Decision 1655/QD- TCHQ amending and supplementing the regulation on functions, missions, powers and the organisational structure of the division under the Customs Department of Goods Verification issued with Decision 2558/QD-TCHQ dated August 15, 2016.
