The Ministry of Industry and Trade removes many procedures to facilitate businesses

The issue of Decision No. 4846 shows the determination of the Ministry of Industry and Trade in the solving of enterprises’s problems.

On 9th December 2016, the Minister of Industry and Trade issued Decision 4846/QD-BCT to approve the Plan on simplifying administrative procedures in the field of the State management of the Ministry of Industry and Trade in 2017.

According to this Decision, a series of administrative procedures in 17 fields have been repealed and amended to remove difficulties for enterprises, including: steel, gas, food safety, production and business of wine, electricity, petroleum, trade promotion, import and export, chemicals, international trade and competition management.

Gas businesses are supported

For the gas business, the Ministry of Industry and Trade has annulled a series of provisions related to the certification of eligibility for import and export of LPG, LNG and CNG as stipulated in Decree No. 19/2016/ND-CP and Circular No. 03/2016/TT-BCT.

Specifically, the Ministry of Industry and Trade has repealed a provision regulating that a LPG distribution system in the country must have at least 40 general agents or LPG dealers; a provision that requires documents to establish a distribution system; a provision that LPG cylinders must be owned by LPG import and export traders and all provisions that LPG/LNG/CNG filling and supply stations for vehicles must be owned by general gas traders.

Along with that, the Ministry of Industry and Trade has also simplified the license procedures and removed a provision related to the owning of storage tanks.

For the certification to operate as agents in the LPG business as specified in Decree 19 and Circular 03, the Ministry of Industry and Trade has decided to annul a provision that an agent must choose and make a contract with 1 general agent or 3 LPG wholesale traders, and simplified certification procedures for qualification as LPG dealers.

With the certification for qualification as LPG dealers stipulated in Decree No. 19, the Ministry of Industry and Trade has decided to repeal a provision regulating that a distribution system must have 40 general agents or agents for importing and exporting LPG and at least 20 general agents or agents for distribution of LPG traders.

Notably, the time for issuing certificates of business, export and trading of gas has been decreased from 30 working days to 15 working days.

Many provisions on energy, petroleum and chemicals annulled

Many procedures for energy labeling have been adjusted to remove difficulties for businesses. Accordingly, the Ministry of Industry and Trade has changed a regulation on "assessment and certification of energy labeling before importing" to "assessment and certification of energy labeling before entering the market" in Article 8, Circular No. 07/2012/TT-BCT.

The simplification of the dossier to request for certification of energy labeling is conducted as follows: Removing "copies of contracts with foreign suppliers and declarations for imported goods"; "records and documents related to the process of quality management of businesses" and "other records and certificates related to quality management". Besides, changing a provision that "the validity of test results issued by the Testing Organization does not exceed 6 months from the date of issue" to a provision that "the validity of test results depends on the Testing Organization".

Administrative procedures "assessment and certification of energy labeling" is implemented in the form of online public services at level 4.

The designation of the Testing Organization stipulated in Circular No. 07/2012/TT-BCT is implemented as follows:

Changing "copies" defined in Point b, Paragraph 2 of Article 6 to "copies from the original documents or certified copies with original documents for comparison" and issuing the Certificate of registration in accordance with Circular 08/2009/TT-BKHCN of 8th April 2009 guiding orders and procedures for registration in accordance with "Point b, Paragraph 2 of Article 6”.

For the petroleum business, the Ministry of Industry and Trade has issued more specific provisions on the form of submitting records and dossiers (directly, by mail and on the Internet) for the granting of certificates as petroleum distributors and general petroleum dealers stipulated in Decree No. 83/2014/ND-CP on petroleum business.

The time for receiving, amending and supplementing a number of documents has been reduced from 7 working days to 3 working days; and the time for evaluation, assessment and certification has been also reduced from 30 working days to 20 working days.

In the chemicals sector, the Ministry of Industry and Trade has eliminated administrative procedures on "confirmation of chemicals declarations" stipulated in Decree No. 26/2011/ND-CP, Circular No. 40/2011/TT-BCT and Circular No. 06/2015/TT-BCT. The procedures for imported chemicals declarations have been simplified in the form of online public services at level 4 through the National Single Window.
