Problems in import procedures for used Lexus cars

According to the findings of a reporter of Customs Newspaper, on June 24, 2016, Trang Ha Transport Ltd Company implemented import procedures for a used Lexus RX 350 car (gasoline, 3.5L) made in Japan in 2015 with overseas registration on December 28, 2015.

However, according to the test results of the Registry Department, this car did not meet the requirements of used automobiles as stipulated in Joint Circular No. 03/2006/TTLT BTM-BTC-BCA-BGTVT guiding import procedures for used automobiles less than 16 seats.

The reason was that although indication on the vehicle odometer showed a distance of 11,554 kilometers, it did not match the technical condition of the vehicle. Thus, the Registry Department said that the technical condition of this car was equivalent to the same category of vehicles less with than 10,000 kilometers (categorized as a new car).

According to Hai Phong Customs Department, the implementation of import procedures for this car faced many obstacles because it didn’t meet the conditions for import of used cars and also did not meet the conditions for import of new cars.

In fact, the vehicle was registered abroad, while under the provisions of Circular 20/2011 / TT-BCT of the Ministry of Industry and Trade, in order to import new cars, an enterprise must present a Certificate of authorized import enterprises; and Certificate of warranty and maintenance services, etc. But Trang Ha Transport Ltd Company didn’t have these legal documents.

Regarding problems of Hai Phong Customs Department, on August 10, 2016, a reporter of Customs Newspaper contacted Mr. Ngo Minh Hai, the Deputy Director of Customs Control and Supervision (the General Department of Vietnam Customs). Mr. Ngo Minh Hai said, this case was quite rare. However, based on the conclusions of the Registry Department, he could confirm that this car was not defined as used automobile as specified in Joint Circular 03.

"For the procedures to import new cars in case of enterprises lacking legal certificates or documents under the provisions of Circular 20, the General Department of Vietnam Customs will consult the Ministry of Industry and Trade to direct Hai Phong Customs Department to handle", Mr. Ngo Minh Hai said.
