Lang Son: Strictly handle acts of smuggling, commercial fraud and counterfeit goods

Prosecution of 229 cases, 333 subjects

According to the Steering Committee 389 of Lang Son province, in the first months of the year, the functional forces in the area inspected and handled 2,856 violations, an increase of 44.97% over the same period; sanctioning administrative violations 2,490 cases, up 43.76% over the same period. The total amount of money handled for administrative violations is 23,409.4 million VND, up 8.2%. Up to now, 229 cases have been prosecuted, an increase of 41.36%, 333 subjects, an increase of 39.33% over the same period.

The above results show that the Steering Committee 389 of Lang Son province has actively developed a plan to direct the implementation of the task of combating smuggling, commercial fraud and counterfeiting in 2023 and the peak of the Lunar New Year in 2023 from the end of 2022, thereby having a clear effect on stabilizing the market, protecting the legitimate rights and interests of business organizations, individuals and consumers, ensuring the supply and demand of goods for reproduction after the Covid-19 pandemic.

At the same time, strictly implement the plans and directives of the Prime Minister, the 389 National Steering Committee, the Provincial Party Committee and the Provincial People's Committee. On that basis, members of Steering Committee 389 of provinces, Steering Committee of 389 at district and city levels, according to their assigned functions, tasks and geographical areas, have developed specific plans, suitable solutions with the locality to prevent, check and handle with positive effect, preventing the formation of hot spots for smuggling in the locality; The sense of law observance in business and choice of goods among all classes of consumers continues to have positive changes.

Speaking at the conference to review the fight against smuggling, trade fraud and counterfeit goods in the first 6 months of the year, and to deploy the tasks for the last 6 months of 2023 on July 12, Ms. Doan Thu Ha, Vice Chairman of the People's Committee , Head of Steering Committee 389 Lang Son, assessed that smuggling and illegal transportation of goods through trails and openings in the border area had been controlled. The situation of the domestic market in the area is basically stable, there is no phenomenon of price increase, price pressure, hoarding goods, spreading false information causing market turmoil; business environment, import-export activities through the province continue to be interested, creating favorable conditions; The legitimate rights and interests of enterprises, consumers, manufacturers and legitimate businesses continue to be protected.

Strictly handle the act of "abetting" smuggling

Ms. Doan Thu Ha emphasized, the situation of smuggling and illegal transportation of goods across the border decreased compared to the same period in previous years because functional forces on both sides of the border strengthened inspection, control and prevention. Illegal entry and exit, combating smuggling and illegal cross-border transportation of goods, and prevention of the Covid-19 epidemic.

However, in the coming time, smuggling, trade fraud and fake goods will continue to have more complicated and sophisticated developments due to the impact of mechanisms and policies on goods circulation in the progress of international economic integration, the impact of the digital economy. In addition to the advantages from import-export activities and online business, there are illegal transportation and trading of goods across borders and border gates, trade fraud, tax evasion, trading and transportation of goods. Prohibited goods, smuggled goods, production and trading of counterfeit goods, poor quality goods, goods infringing intellectual property rights, goods that do not ensure quality, food hygiene and safety, etc.

In the coming time, Ms. Doan Thu Ha asked the 389 Steering Committees of districts, cities, agencies, units and relevant functional forces to identify the work of anti-smuggling, commercial fraud and counterfeiting as a key, regular and long-term task; thoroughly grasp and strictly implement the direction of the central government and the province on the fight against smuggling, commercial fraud and fake goods.

Along with that, the functional forces need to actively assess the actual situation and results of implementation by sectors, fields and localities in charge to identify and specify outstanding issues in terms of subjects, lines, key geographical areas, fields and products as well as methods and tricks, acts of smuggling, commercial fraud and counterfeit goods in order to promptly develop plans to fight and prevent; well perform the rotation of cadres in sensitive areas, fields and jobs in order to prevent negativity and corruption, and promptly handle strictly collectives and individuals that have violations; strengthen coordination to ensure timely, close and synchronous, especially coordination in sharing information on supervision and inspection of goods; uphold the roles and responsibilities of the heads of relevant sectors, localities and units in inspecting and supervising officials on duty.

In addition, coordination in inspection and examination to ensure that there are no duplicate content and objects; clearly define roles, responsibilities and areas of responsibility. Capture and share guidelines, policies and new information to promptly have solutions to create favorable conditions and support enterprises, organizations and individuals with production and business activities in the area and through the province to promote investment attraction, local socio-economic development.

Regarding press information about the phenomenon of "making laws", "protecting" for customs clearance of goods, the negativity at Chi Ma border gate, Deputy Director of Lang Son Customs Department Vy Cong Tuong said, Immediately after receiving the information reflected in the press, the Chi Ma border gate Customs Branch held a meeting with the leaders of the branch, the leaders of the team and the team and actively established the information verification team, clarifying the information. information and other relevant contents, and at the same time propose and strictly handle relevant organizations and individuals (if any).

Accordingly, the sub-department has worked with a number of enterprises that regularly carry out customs procedures through the branch, enterprises managing yards and warehouses; verify objects with names such as articles published, make a record of the incident as a basis for reporting to Lang Son Customs Department for knowledge and direction.

Specifically, the branch has invited and worked with 24 enterprises having import-export activities through the area and 8 enterprises operating in warehouses and yards. In particular, these enterprises often open declarations at the branch and import goods of all kinds, which are consumer goods, general goods, express delivery goods, dry food, ceramic tiles, fabrics, etc. At the same time, all of them directly signed contracts with Chinese partners and all sent staff to directly carry out customs procedures without hiring services or through customs agents.

In the process of carrying out customs procedures through Chi Ma border gate, enterprises make customs declarations in accordance with the provisions of the law and have been carried out customs procedures by Chi Ma border gate Customs Sub-Department. Customs inspection and supervision in accordance with regulations, creating all conditions to guide procedures, fast customs clearance of goods, without requirements and harassment of enterprises. Customs authorities do not require enterprises to pay any amount outside of regulations.

After receiving the media reports, the Customs found that, during the importation of goods through Chi Ma border gate, enterprises did not receive notices or requests from organizations and individuals about the payments through Chi Ma border gate to do customs procedures, clear goods.
