How does Hai Phong Customs answer Duc Thang Company’s complaint about import procedures of steel?

Recently, Duc Thang Import Export Production Limited Company has complained to some press agencies that it has had difficulties with Hai Phong Customs when carrying out Customs procedures for imported steel, and all its steel shipments were subject to physical inspection and a sample taken.
According to the reporter, this problem was a previous complaint by the company. Hai Phong Customs answered the company by an official letter.
Specifically, in November 2017, Hai Phong Customs Department issued an official letter to answer the Company’s complaint and sent the letter to the Hai Phong Planning and Investment Department to report to Hai Phong City People's Committee under the instruction of the city.
Since 2015 to the present day, the company has imported these kind of goods about 30 times (implementing at some Customs Branches under Hai Phong Customs Department). All the goods were classified into Red Channel and a sample taken for analysis and classification.
According to Hai Phong Customs, currently, the channel classification for imported and exported goods has been implemented in line with the principle of risk management application through analysis, evaluation and development of criteria on the Customs system
In the past, some steel items were identified as a sensitive item with implicitness of risk and infringement. Hence, the Red channel classification (implementing physical inspection and taking example for analysis and classification) for the steel wire shipments of the company in the past was based on this principle.
“The Red channel classification for the shipments of the company was entirely implemented by VNACCS/VCIS. The Customs Branch did not transfer any of the company’s shipment to Red channel to inspect. All the shipments were classified by the system” -Ms. Nguyen Thi Thu Hien, Manager of Hai Phong Customs Branch Zone I (one of the units carrying out Customs procedures for Duc Thang Company) talked to the reporter.
Regarding the taking of a sample for verification, Hai Phong Customs Department said that the taking sample and regulations on quantity, size and length for each sample were stipulated in Circular 14/2015/TT-BTC dated 30th January, 2015 of the Minister of Finance and the guidance of the General Department of Vietnam Customs.
What are regulations on risk management in Customs operation? Article 17 of Customs Law stipulates on risk management in Customs operation as follow: 1. Customs shall apply the risk management for decision on Customs inspection and supervision of goods and means of transport; support the prevention and combat of smuggling and illegal cross-border transportation of goods. 2. Risk management applicable in Customs operations covers the collection and processing of Customs information; development of criteria for assessment of law compliance by the Customs declarant, and classification of risks; and implementation of appropriate Customs management measures. 3. Customs shall manage and apply the system of operational information so that it can automatically integrate and process data to serve the application of risk management in Customs operations. 4. The Minister of Finance shall set criteria for assessment of law compliance by Customs declarant, classification of risks and application of risk management in Customs operations. |
