HCM City Customs holds dialogue with nearly 100 export processing and export production enterprises

VCN - At a dialogue with businesses in the field of export processing and export production on September 29, the Processing Customs Branch (HCM City Customs Department) noted and recommended businesses many important contents to avoid mistakes.

Manager of Processing Customs Branch Nguyen Dinh Nam said that in the past two years due to the influence of the Covid-19 pandemic, the Customs authority did not hold direct dialogues with businesses, but through many forms, the unit has accompanied businesses to comply with regulations on types of export processing and export production.

Besides the problems that enterprises have discussed directly with the Processing Customs Branch when carrying out customs procedures, since the beginning of 2022, the unit has only received 11 problems from businesses sent via documents and was immediately replied to by the branch.

To continue to facilitate export processing and export production, leaders of the Processing Customs Branch have made a series of commitments such as improving the efficiency of online public service for administrative procedures in the field of customs for the business community; applying measures to reform administrative procedures, accompany enterprises in order to create favorable conditions for import and export activities; continue to widely disseminate to the business community about the declaration of tax exemption, reduction and refund dossiers on the system of tax exemption, reduction and refund in accordance with regulations in order to speed up the tax refund.

During the year, the unit gave specific instructions for 12 enterprises to declare on the tax refund and exemption system.

A new point in this dialogue of the Processing Customs Branch is giving seven recommendations to suggest businesses cooperate well with Customs authority when carrying out customs procedures. These contents are highly appreciated and agreed upon by enterprises.

In particular, the Branch requests enterprises to coordinate with the Customs to handle backlog issues. For example, submitting a final settlement report on the use of imported raw materials and supplies for export production exported. The reason is that in the list of businesses that must submit the final settlement report in 2021, currently, there are 12 enterprises that have not submitted the final settlement report.

It is recommended that enterprises pay attention to submit the final settlement report on time as prescribed in Article 60 of Circular 38/2015/TT-BTC dated March 25, 2015 of the Ministry of Finance (amended and supplemented in Clause 39, Article 1 of Circular 39/2018/TT-BTC dated April 20, 2018) to avoid administrative violations, affecting the assessment of legal compliance of enterprises.

According to the leader of the processing customs branch, in 2021, there were 7,921 cases of making additional declarations of customs dossiers, and 1,223 cases of cancellation of customs declarations arising at the branch.

Enterprises often cancel declarations for the following reasons: Wrong type code, criteria of customs branch, duplicate information, export declaration exceeding deadline of 15 days, on-spot export declaration canceling export transactions, import.

In order to minimize time and effort of both Customs authorities and enterprises in handling the cancellation of customs declarations, and making additional declarations of customs documents, it is recommended that enterprises remind the division in charge of import-export procedures or customs broker agents to be careful and responsible in correctly and fully declaring the criteria specified in the customs declaration.

The Customs also noted that enterprises strictly manage digital signatures in order to limit cases of digital signatures being used for illegal activities; keep in regular contact with the customs office (where the procedures are handled), in order to avoid the mistake of information from the Customs office to the enterprise due to the intermediary stages; strictly comply with the provisions of the law on customs; reflect inadequacies and obstacles hindering export and import activities of enterprises.

Notably, the leader of the Processing Customs Branch suggested that enterprises actively participate in customs procedures that have been provided with online public services. In the past eight months, the number of dossiers that cancel customs declarations and make additional customs declarations made through online public services is very low (only 145 dossiers), only 9% of the number of paper dossiers (cancelling declarations, additional declarations of customs dossiers) submitted directly to the customs authority (1,626 dossiers).
