Handling 63 containers of waste products for import avoidance benefit

VCN – According to a report of HCM City Customs Department, there are 63 containers of imported waste product stuck in their management area. Hence, they need to have specific guidance to handle those containers in order to avoid legitimizing the import of unqualified goods by auction.

Those containers are stuck due to enterprises that do not have qualified import condition under the Decree No.38/2015/ND-CP of the Government.

Facing the above concerns, the General Department of Vietnam Customs recently sent a document to the Ministry of Natural Resources and Environment asking for opinions on the handling of waste products in the customs operation area.

According to the General Department of Vietnam Customs, waste product must meet the conditions stipulated in Decree No.38/2015 / ND-CP on waste and scrap management. At the same time, there are no regulations on units participating in bidding for unsold scrap to meet the conditions of other importers as stipulated in Decree No.38/2015 / ND-CP, or the enterprises that run appropriate business as stipulated could participate in bidding.

In order to handle the consignment of goods subject to specialized management in accordance with the regulations, avoiding the legitimate import of qualified goods in the form of auction of unsold goods, the General Department of Vietnam Customs requests the Ministry of Natural Resources and the Environment to give opinions on the handling of goods as waste remains in the area of customs operation, and whether enterprises participating in the bidding must meet the conditions as for import enterprises or must assess the capacity before bidding.

Based on the opinions of the Ministry of Natural Resources and Environment, the General Department of Vietnam Customs shall guide the provincial Customs Departments to handle goods stuck in port in a timely fashion and in compliance with the provisions of law.
