Get opinion on draft circular supplementing and amending regulations on risk management

At the conference, Deputy Director General Hoang Viet Cuong said that during developing legal documents in 2023, the General Department of Vietnam Customs (GDVC) reported and was approved by the Ministry of Finance to develop a circular supplementing and amending Circular 81/2019/TT-BTC, including revising regulations related to risk management.
Currently, more than 204,763 enterprises have been assessed their compliance with customs law. However, based on each compliance level (including 5 levels: level 1: authorized economic operator; level 2: high compliance; level 3: moderate compliance; level 4: low compliance; level 5: non-compliance), the number of enterprises at level 4 accounted for 72.69%, and enterprises at level 1 accounted for 0.04%, showing inappropriate proportion.
“Recently, the GDVC has piloted the program to encourage and support private sector to voluntarily comply with the customs law, showing that it is necessary to improve the relevant legal basis. In addition, the reduction of procedures and rate of inspection to facilitate the business community and shorten customs clearance time should be reviewed and revised in line with the reality” said the Deputy Director General.
The GDVC has assigned the Risk Management Department to develop the draft circular.
Currently, the Risk Management Department has consulted other departments and local customs departments. The GDVC has get opinion of departments under the Ministry of Finance.

The conference aims to gather feedback from local customs departments and GDVC’s departments on revising regulations on risk management in customs control.
The draft circular will revise 15 articles, supplement one article and amend 5 appendices.
The representatives of these departments discussed on six key contents.
For compliance assessment group, Article 10 of Circular 81, customs declarants are assessed at 5 compliance levels.
However, more than 50% of assessed enterprises are not engaged in import and export activities, so the assessment results are not accurate. Therefore, the draft Circular needs to consider the subjects to be included in the compliance assessment.
