Da Nang Customs confirms 31 export processing enterprises eligible for inspection and supervision

VCN – Implementing regulations on the conditions for customs inspection and supervision for export processing enterprises following Decree 18/2021/NĐ-CP of the Government, until now, Da Nang Customs Department has carried out inspections and confirmation for 31 export processing enterprises (EPE).

Decree 18/2021/NĐ-CP dated March 11, 2021 amending and supplementing a number of articles of Decree 134/2016/NĐ-CP dated September 1, 2016 of the Government stipulating some specific guidelines for the law on export and import duties took effect from April 25, 2021.

Accordingly, Point 10, Article 1 regulates the conditions of customs inspection and supervision and tax policies for export processing that is in a non-tariff zone.

Relating to the above regulations, the General Department of Vietnam Customs has promulgated Decision 247/QĐ-TCHQ dated March 2, 2022 stipulating the methods for camera surveillance systems and data exchange of export processing enterprises with customs authorities, Document No. 697/TCHQ-GSQL dated March 2, 2022, Document No.730/TCHQ-GSQL dated March 4, 2022 and Document No. 358/TCHQ-GSQL dated March 22, 2022 guiding the implementation.

Da Nang Customs Department said customs branches managing export processing enterprises had already disseminated and announced the contents about conditions of customs inspection and supervision to export processing enterprises operating in the area in order to proactively complete conditions and notify the customs authority to check and confirm, avoiding interruption to the application of tariff policies for the non-tariff zone.

The communication is carried out under many methods such as listing documents, organizing a conference, online conferences, email, notifications, working directly at the enterprises’ office to exchange information and guiding specifically with legal representatives or authorized persons of export processing enterprises in order to ensure all export processing enterprises in the management areas are updated with the new regulations.

As of April 14, 2022, Da Nang Customs Department has checked and confirmed 31 out of 32 export processing enterprises are eligible for customs inspection and supervision; one export processing enterprise has not been confirmed as it is in the process of carrying out the procedure of changing the business type from export processing enterprises to an enterprise that does not enjoy the same regime.
