Bac Ninh Customs issues violation warnings to import-export businesses

VCN –Through inspection, supervision, post-clearance audit and checking settlement reports…, Bac Ninh Customs Department has reviewed, analyzed and issued violation warnings to the business community for them to understand and prevent violations.

This is new content at the second Customs-Business Dialogue Conference in 2024 held by Bac Ninh Customs Department on August 13, 2024.

The dialogue conference drew participation from 150 import-export enterprises in the areas managed by Bac Ninh Customs Department including provinces of Bac Ninh, Bac Giang and Thai Nguyen.

At the opening of the conference, Deputy Director of Bac Ninh Customs Department Pham Chi Thanh said that in the first seven months of 2024, 6,275 enterprises carried out customs procedures at Bac Ninh Customs Department, including 1,188 export processing and manufacturing enterprises and export processing enterprises.

Import-export goods are not subject to tax of export processing enterprises; goods are subject to tax exemption and some taxable regimes.

“Over the past years, Bac Ninh Customs Department has regularly supported enterprises, proposed supportive policies, directed administrative reform and improved the capacity of officers; implemented the interconnected single window mechanism and modern electronic single window model to minimize procedures and shorten time in processing procedures for businesses. The department has focused on inspection and examination to reduce overlaps and troubles for businesses; created the most favorable conditions for businesses to stabilize and develop production and business,’’ Thanh said.

Additionally, Bac Ninh Customs Department has analyzed violations that were detected through inspection, supervision, post-clearance audit, checking settlement reports...for the business community to understand and prevent violations in customs processes.

The representatives of Technical Division and Post-clearance Audit Branch under Bac Ninh Customs Department introduced customs law policies, tax laws, and foreign trade laws. At the same time, providing warnings on violations and errors via post-clearance audit such as errors related to management policies for goods subject to tax-exempt and non-taxable goods, destroying excess raw materials, implementing on-site import and export declarations...

For example, the enterprises declare the description of goods inconsistent with regulations on composition, structure, uses... due to not properly identifying the nature of the goods.

Some enterprises have provided inappropriate documents to the C/O issuer. Some enterprises have falsely declared the number of import declaration in the value percentage calculation table when applying for the C/O...

At the conference, representatives of many businesses recognized and appreciated the administrative reform by Bac Ninh Customs, helping to shorten customs clearance time, reduce costs, and create favorable conditions for the business community. Businesses believe that motivated by the support of the Customs, import and export activities at areas will be promoted.

Leaders of Bac Ninh Customs Department and branches listened and answered businesses' problems related to customs procedures and tax policies for each specific item.

For example, the business's problem is related to using the regime code for imported machinery and equipment to replace some damaged equipment during operation process.

The department has instructed the business to use regime code B13.

In the first seven months of 2024, the total import-export turnover in the area under the management of Bac Ninh Customs Department reached US$103.7 billion, meeting 105% year-on-year and 21.3% of the total import-export turnover of the whole Customs industry. The department processed a total of 1.18 million declarations (including on-site import and export declarations), meeting 118% compared to the same period in 2023.

The department collected VND8,155 billion, meeting 122% year-on-year and 73% compared with the target.
