Prosecute the case of importing prohibited goods relating to “ghost” enterprise

The above shipment was inspected at the end of 2017. When the container was imported to Cat Lai port, through pre-scanning, customs authorities detected the images showed the container contained prohibited goods. Thus, the shipment was subjected to specialized supervision for combating and prevention.

Although the company was receiving the delivery order, when detecting the customs authority put the shipment into the case for specialized supervision, and issued a decision for searching, the representative of New Binh Phuoc Export Import Production Trading Limited Company refused to receive that shipment.

Through the inspection, the Saigon port area 1 Customs Branch detected all the goods contained in the container were used household items, and in the list of prohibited import goods, including: 129 washing machines; 40 sets of air-conditioner; 90 rice cookers; tens of electric fans, and kitchen equipment ... worth over 1.1 billion VND.

Moreover, through the expanding investigation and verification, Saigon port area 1 Customs Branch detected that New Binh Phuoc Export Import Production Trading Limited Company was not operating at the office as business register. According to the Tax Department of Dong Xoai Towns, Binh Phuoc province, from the time of establishment to the time of violation, the enterprise has not submitted a tax declaration dossier. After 6 months of being licensed, tax authorities and local authorities checked and detected that there was no business operating at the registered address.

It is known that New Binh Phuoc Export Import Production Trading Limited Company was licensed and established in 2017. The smugglers used a fake license and dossiers in order to establish the company and used legal entities for smuggling.

According to the HCM City Customs Department, the behavior of New Binh Phuoc Export Import Production Trading Limited Company deliberately acted contrary to the provisions of law. With the above evidence, the Saigon port area 1 Customs Branch has prosecuted the criminal case of "smuggling" related to the above case.
