Direct detection

After several days of follow-up, early on the morning of 18th August 2017, the Southern Coastal Control Team (Team 3) - the Department of Anti-Smuggling and Investigation, under the General Department of Vietnam Customs in cooperation with Division 6, C74 (the Ministry of Public Security) caught the ship named TRADEWIND OCEAN and the ship named My Hung 09 illegally exchanging petrol in the area of the town of Dai Ngai, Long Phu district, Soc Trang.

Mr. Vu Ngoc Khiem, the Deputy Head of Team 3, who directly participated in the case, said that through inspection and fighting with sailors on board, TRADEWIND OCEAN Captain Mr. Nguyen Thanh Tung (born in 1986, resided in Truc Thai, Truc Ninh, Nam Dinh) declared that, after running around from the Nha Be River - Ho Chi Minh City to the buoy 0, Soai Rap, he received the order of the Director of Phuc Thanh Transport Import Export Limited Company (6/5 Tran Phu, Ward 4, District 5, Ho Chi Minh City). Accordingly, TRADEWIND OCEAN was requested to collect goods at a distance of 20 nautical miles from Xoai Rap to the North East. (This location is currently unknown because the captain has cleared all data on the GPS).

Taking orders, wait until midnight of 14th August 2017, TRADEWIND OCEAN ship meet an unknown ship to receive goods without count records and records delivery. Besides, TRADEWIND OCEAN ship did not remain seal of cargoes and did not take samples as prescribed. Mr. Tung then controlled the TRADEWIND OCEAN ship toward Dinh An estuary and ran into the Hau River in the area of Dai Ngai town, Long Phu district, Soc Trang province, pumping all of the goods to My Hung 09 and was detected by compentent forces.

Signs of legitimating illicit petroleum

According to the Deputy Head of Team 3, Mr. Vu Ngoc Khiem, through the inspections of the dossiers and papers related to petrol as mentioned about, the working team discovered that there was a VAT receipt No. 0000007 dated 15th August 2017 and 1 delivery order No. 7 / 2017- XK dated 15th July 2017 of Phuc Thanh Transportation Import Export Trading Co., Ltd with the quantity of 1,970,000 liters of A92 petrol (equivalent to 1,970 m3 of A92 petrol). According to the receipt of the TRADEWIND OCEAN Captain Nguyen Thanh Tung, this invoice was issued by a man on board to float at Buoy No.0 (Mr. Tung did not remember the name of the ship). Meanwhile, the estimated number of goods was only about 500 m3 of A92 gasoline.

Based on the initial verification of Team 3 for the company issuing the above VAT invoice, the local police said at the address on the invoice No. 6/5 Tran Phu, Ward 4, District 5, Ho Chi Minh City, there were no business activities, and this was a citizen's home. The results of verification at the Tax Department of Ho Chi Minh City showed that Phuc Thanh Transportation Import-Export Co., Ltd did not incur taxes and there were no changes in tax reporting address.

Checking the contract of petroleum trading by the captain of My Hung 09, the Task Force discovered many abnormal content, such as the place of delivery of goods on the contract express delivery at the warehouse of Phuc Thanh Transportation Import-Export Co., Ltd, but in fact, the cargo was delivered at sea, not in accordance with the terms of the contract; the receiver of goods as My Hung Co., Ltd. has not signed the delivery. Thus, the ownership of gasoline to the above mentioned belonged to the Phuc Thanh Transportation Import Export Trading Limited Company.

According to Mr. Khiem, initial investigation showed that there were signs of legitimizing the dossier for the transfer of the above number of petrol, so competent forces have asked the captain of the ship named TRADEWIND OCEAN and ship named My Hung 09 to move to the port of Team 3 in Vung Tau to serve the investigation, verification and clarification.Till now, the Task Force has divided into several teams to investigate the case.
