Shorten time for construction permits

Reporting on situation and results of the first six months in implementing the Government's Resolution No. 02/2020/NQ-CP on continuing to perform key tasks and solutions to improve the business environment and enhance national competitiveness in 2020, the Minister of Planning and Investment said, as of June 25, the Ministry had received six-month reports on the situation and results of implementing the Resolution from 18 ministries and branches, as well as 41 out of 63 provinces and cities.

In the first six months of 2020, the implementation of the Resolution has slowed down due to the impact of the Covid-19 pandemic. Ministries, branches and localities focused on implementing anti-pandemic solutions and supporting businesses to overcome difficulties caused by Covid-19.

Regarding the results of improving the business environment and competitiveness when starting a business, according to Decree No. 22/2020/ND-CP amending and supplementing a number of articles of Decree No. 139/2016/ND-CP stipulating license fees, enterprises are exempt from license fees in the first year of establishment. Thanks to this reform, the process of starting a business in Vietnam decreased to seven procedures (formerly eight procedures) and the cost decreased by VND2 million.

Concerning construction licensing, the Ministry of Planning and Investment said the law amending and supplementing a number of articles of the Construction Law, which was passed by the National Assembly on June 17, 2020, shortened the time for construction permit to 20 days, and evaluation procedures of construction design with fire safety and environmental protection procedures were carried out simultaneously.

In terms of tax payment and social insurance, the deployment of e-services is one of the priorities for tax payment and social insurance reforms. From January 1, 2020 to June 10, 2020, 539,480 invoices have been issued with the code; and electronic registration fee payment has been implemented in Hanoi and Ho Chi Minh City since March 12, 2020.

Specialized inspection has not changed much

The Ministry of Planning and Investment also said the management and specialized inspection of import and export goods slowed down with little change in the first six months.

The Ministry of Finance is developing a specialized inspection reform scheme in the direction that the Customs office is the focal point for quality inspection at border gates (except for goods related to security, national defense, and quarantine), and specialized management ministries will perform post-inspection. However, the scheme is a draft, which needs to be discussed to be unified among the specialized management ministries.

Besides, problems and inadequacies in management and specialized inspection, which have been reflected by the business community many times and at many places, have been slowly solved, such as: requirement for State inspection of labor safety before customs clearance for group-2 commodity products of the Ministry of Labor, War Invalids and Social Affairs; State inspection on quality of animal feed; and checking the energy performance.

This is the seventh consecutive year that the Government has issued a Resolution on improving the business environment and enhancing national competitiveness. Resolution 02 has set five key reforms, including: improving the quality of business environment and competitiveness; substantially reforming the regulations on business conditions; continuing to implement comprehensive reforms of management, specialized inspection and connecting the National Single Window, and ASEAN Single Window; promoting cashless payments and providing online public services at level four; and developing an innovative ecosystem to support and encourage start-up businesses.

Regarding the reform of business conditions, according to the MPI representative, the Investment Law passed by the National Assembly on June 17, 2020 has abolished 21 business lines; revised 24 branches and trades and supplemented seven business lines.

Most of the ministries and agencies have completed their statistics and posted full regulations on business conditions in the fields under their management. However, in fact, most ministries and agencies have not monitored and assessed the effectiveness of implementing these reforms.
