Lach Huyen port Trading Service Company is fined more than 61 million VND because of declaring wrong goods name

VCN - Lach Huyen port Trading Service Joint Stock Company imported more than 270 tons of steel and declared goods with an import tariff of 5%. However, Customs authorities determined that the import goods in large quantities, were subject to be taxed at 10% and 20%.

According to the Permanent Office of the National Steering Committee 389, the case was detected and processed by Dinh Vu Port Customs Branch, Hai Phong Customs Department.

Through the findings of the Customs News reporter, in the process of implementing customs procedure, Lach Huyen port Trading Service Joint Stock Company declared the imported goods as "color coated steel coil, flat, non-alloy steel, carbon content <0.6 %, standard of JIS G3312, brand new goods of 100... HS code is 7210.70.11 ", with a preferential import tax rate of 5%.

However, through the management of customs authorities, they suspected the actual imported goods were incorrect as declared. Basing on the results of physical inspection, type approval certificates and documents from Sulicontrol Inspection Company, Dinh Vu Port Customs Branch determined that Lach Huyen port Trading Service Joint Stock Company committed violations: Incorrect declaration of type of goods, tax codes, codes and import tax rates leading to the shortfall of payable tax amounts which was detected by the Customs authorities during the process of customs clearance.

Among the total number of over 270 tons of steel imported by the Company, there were only 35.5 tons of goods with HS code 7210.70.11 with the preferential import tax rate of 5%. The remaining items were 103 tons of steel that belong to HS code 7210.30.11 with the preferential import tax rate of 10%; and nearly 132 tons of steel under HS code 7210.49.12 with the preferential import tax rate of 20%.

Pursuant to the provisions of law and actual violated goods, Dinh Vu Port Customs Branch decided to sanction administrative violations on Lach Huyen port Trading Service Joint Stock Company with a 20% tax amount which was declared incorrectly, with a total amount of more than 61 million VND.
