However, there have been a lot of problems because of no specific regulations. According to the General Department of Vietnam Customs, Article 2 of Circular No. 14/2010/TT-BXD on product quality management and construction materials and ceramics stipulated: "This Circular applies to import organizations and individuals producing and trading in Vietnam and State authorities related to ceramic products in Vietnam".
According to this provision, enterprises importing granite as raw materials to process and export are not subject to exemption of specialized inspections as prescribed in Circular 14/2010/TT-BXD.
However, some Customs agencies said that imported granite as raw materials for processing to export will not be consumed in the domestic market (except the transfer of inland consumption), so quality control under the provisions of the Ministry of Construction’s Circular No. 14/2010/TT-BXD is unnecessary, increasing costs and administrative procedures. Therefore, a number of Customs agencies have proposed not to perform quality inspections on imported granite as raw materials for processing to export, except the transfer of inland consumption.
In order to have sufficient legal basis to guide subordinate units to implement, the General Department of Vietnam Customs is requesting the Ministry of Construction for comments about the above problems.
In addition, specialized inspections for imported granite used for manufacturing, not used as construction materials should also be clarified. According to Article 1 of Circular 14/2010/TT-BXD, "this Circular stipulates product quality management and construction materials including ceramic products of Group 2 as defined in the Law on product quality, including the list of ceramic products to be conducted safety and quality inspections".
From the above provisions, the General Department of Vietnam Customs said that the Ministry of Construction should also clarify that in the case where enterprises used imported granite to produce or process to export such as furniture, whether these enterprises must be subject to specialized inspections?

To avoid problems arising as well as loopholes related to the control of imported goods, the General Department of Vietnam Customs said that the Customs force shall perform quality inspections on imported granite and ceramic products regardless of the purpose of using these products as declared by importers.
