For example, the Ministry of Agriculture and Rural Development is developing a draft Circular replacing Circular 12/2015/TT-BNNPTNN guiding inspection of foods safety for products of plant origin.
The draft stipulates 3 levels of inspection that are; tightened inspection, normal inspection and reduced inspection. However, according to the General Department of Vietnam Customs, the levels of inspection described in the draft are not measures of risk management in the full sense of the principle of risk management, because business’s can still be inspected and must submit a certificate of food safety issued by the competent agency to the Customs for Custom clearance, including businesses that comply well with the law.
“This means that 100% of the imports are still subject to food safety inspection before being cleared and rate of pre-clearance audit is not reduced” GDVC said.
In order to comply with the directives of the Government and the Prime Minister in Decree 19/ND-CP the GDVC has proposed the drafting committee to consider the change of inspection method and application of risk management rules in specialized inspection for import and export goods to shorten clearance time.

Currently, the Ministry of Health is chairing the development of draft Decree amending and supplementing the Government’s Decree 38/2012/ND-CP, detailing the implementation of a number of articles of Law on Foods Safety. Accordingly, the draft Decree has many amendments related to the food safety inspection for import and export goods such as the application of risk management principles in the inspection, and import goods subject to exemption from foods safety inspection… Hence, the GDVC proposed that when developing the draft Circular, it needs to closely follow contents of the draft Decree or to wait for the promulgation of the draft Decree.
