Customs strengthens dialouge, solving difficulties for enterprises
In 2021, the General Department of Vietnam Customs set a goal on continuing to control the issuance of administrative procedures, improve the efficiency of coordination among units in commenting, reviewing and verifying legal documents regulating on administrative procedures, ensuring to only issue necessary, reasonable, legal administrative procedures and lowest compliance costs. At the same time, to promote reforms of administrative procedures, focusing on researching and proposing initiatives to reform administrative procedures, especially administrative procedures related to production and business activities of people and firms.
Besides that, to renew the implementation of single window and interlinked single window mechanism in solving administrative procedures towards improving service quality, increasing application of information technology, cutting travel time and social costs and maximally facilitating people and businesses. To fully and promptly announce and publicise administrative procedures; complying with regulations; receive and handle complaints and the recommendations of organisations and individuals on administrative regulations in accordance with the process, while ensuring efficiency.
To achieve these objectives, the General Department of Vietnam Customs requires the units to clearly define control of administrative procedures as a regular job of the units, in which the key task is to simplify administrative procedures and reduce administrative burden for individuals, organisations and businesses. Assigning specific and detailed tasks; to uphold responsibilities of the leader in implementing the task of controlling administrative procedures. Organising evaluation of task performance in the year and set tasks for the next year.

In particular, to assess the impact and calculate the compliance cost of administrative procedures for administrative procedures in the draft legal documents which regulate administrative procedures in accordance with regulations, the assessment of the impact of administrative procedures should be carried out with assessing the impact of the policy in the request for developing legal documents and during the process of drafting legal documents in accordance with the provisions of Decision No. 1480/QD-BTC of the Minister of Finance dated June 29, 2016 promulgates the regulation on formulation, promulgation of legal documents, improvement of the financial legal system, Decision No. 239/QD-BTC of the Minister of Finance dated February 26, 2018 amending and supplementing articles of the regulation on formulation and promulgation of legal documents, completing the legal financial system and Decision No. 3290/QD-TCHQ dated October 3, 2016 of the Director General of Vietnam Customs promulgating the regulation on forming legal documents on customs; elaborate and promulgate regulations and professional processes in customs.
Regarding the publication and publicisation of administrative procedures, the announcement, publicity, updating and listing administrative procedures should be carried out in accordance with current regulations and guidance documents.
The unit in charge of developing legal documents regulating administrative procedures is responsible for reviewing and making statistics on administrative procedures in legal documents right after issuance.
Listing administrative procedures is done through public posting - publicising on the board at the head office or using electronic forms in accordance with infrastructure and technical facilities of the authority.
The General Department of Vietnam Customs also requested units regularly review regulations and administrative procedures to detect regulations, administrative procedures that do not meet criteria of necessity, reasonableness and legality to detect complex administrative procedures, causing difficulties, hindering import-export, entry and exit country and transit activities. On that basis, proposing competent authorities to amend, supplement, replace or cancel administrative procedures that are no longer appropriate. Reviewing administrative procedures to propose amendments and supplements to relevant legal documents to ensure full legal basis for the application of information technology in performing administrative procedures.
The General Department of Vietnam Customs requested affiliated units publicly post at the unit to receive the reflection and recommendations in accordance with the provisions of Circular No. 02/2017/TT-VPCP dated October 31, 2017 of the Office of the Government.
In particular, units need to continue to disseminate and thoroughly grasp customs officials about the content of legal documents on controlling administrative procedures, receive and process complaints and recommendations of individuals and organisations about administrative regulations; regulations on the control of administrative procedures by the Ministry of Finance and the General Department of Vietnam Customs. Directly inspecting the implementation of administrative procedures, helping control of administrative procedures comply with regulations.
Strengthen to organise dialogue with enterprises to answer and disseminate new regulations, mechanisms and policies related to the implementation of administrative procedures; at the same time, grasping difficulties and problems arising for timely handling. Strengthen to propose initiatives relating to administrative reform; apply information technology and build the process of resolving internal administrative procedures quickly, neatly, scientifically, conveniently, and reducing the time spent performing procedures for individuals, organisations and enterprises.
