Customs concretises the implementation of the CPTPP

VCN – To implement the commitments of Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP Agreement) in the customs field, recently, Director General of Vietnam Customs has signed Decision No.1489/QĐ-TCHQ promulgating implementation plan of CPTPP Agreement).

Accordingly, the deployment plan of implementation of commitments in customs field under CPTPP has been concretised as following: propagating, disseminating commitments related to customs; develop legal documents to implement commitments; implementing specific commitments related to the Agreement; implement other tasks of the General Department of Vietnam Customs to participate in a role of coordination.

Specifically, the General Department of Vietnam Customs assigned the units to propagate and disseminate commitments related to customs field; training for customs officials at the operational units, officials at the border gate on specific commitments to ensure accurate and full implementation of the commitments.

At the same time, the General Department of Vietnam Customs will provide information on the introduction and implementation of commitments related to customs in the CPTPP agreement for the Ministry of Industry and Trade in order to upload on the portal.

In building legislation, the General Department of Vietnam Customs established a circular guiding the implementation of commitments in the CPTPP deal (Chapters 3 and 4 of the Agreement) on the inspection and identification of origin of exported and imported goods in customs field.

Coordinating with the Ministry of Industry and Trade to develop a decree on determining the origin of imported goods and customs supervision; coordinate with the Department of International Cooperation of the Ministry of Finance to develop a Decree on promulgating a special preferential tariff in accordance with the CPTPP.

Furthermore, the General Department of Vietnam Customs will work with the Ministry of Science and Technology to develop a Law to amend regulations to implement the CPTPP agreement about the Law on Intellectual Property related to controlling import and export goods.

At the same time, the General Department and Vietnam Customs assigned units to review legal documents to implement commitments in the customs field under the agreement or propose to competent authorities to amend, supplement and abrogate or issue new legal documents.

Regarding the implementation of specific commitments in the agreement, the General Department of Vietnam Customs assigned units to implement the contents of rules of origin in Chapter 3 and rules of origin for textiles and garments in Chapter 4 of the agreement; implementing intellectual property obligations in the Agreement including obligations relating to special requirements on border measures (Article 18, Article 76, Chapter 18).

At the same time, deploying the obligations on cooperation, supervision and verification of textiles to prevent and verify customs violations for textiles.

The units will implement obligations on trade management and facilitation in Chapter 5 of the agreement such as: Contents of customs cooperation (Article 5.2); predetermined codes (Article 5.3); predetermined value (Article 5.3); determine the origin of goods according to Chapter 3 (Article 5.3); respond to requests for advice or provide information (Article 5.4); review and complaint procedures (Article 5.5); automation (Article 5.6); express delivery goods (Article 5.7); sanction (Article 5.8); risk management (Article 5.9); release of goods (Article 5.10); publication (Article 5.11); security (Article 5.12).

Besides, the General Department of Vietnam Customs will coordinate with the Ministry of Industry and Trade to develop projects such as increased use of early warning systems in the field of trade defense; scheme to improve trade defense capacity in the context of participating in new FTAs; building and strengthening inter-branch and local coordination mechanisms in trade defence cases.
