Actually, the story of Khai silk is not rare. In the recent times, the competent authorities have detected many cases that goods originated from China are labeled “made in Vietnam” products. In fact, Chinese products under the guise of Vietnamese goods are not limited to any commodities from luxury products to popular products. From potato, onions, garlic and etc to clothes, machinery, construction products originated from China are labeled “made in Vietnam” by illegal traders to deceive consumers.

Specifically, in the past times, the Customs at Ho Chi Minh City Port detected and prevented dozens of containers of imported goods originated from China but labeled “Made in Vietnam” or famous trademarks. From 2016 to now, the Customs has detected and prevented nearly 20 containers of goods originated from China but labeled famous trademarks and originated from Vietnam and some European countries.

According to the Customs, the regulations on acts of false labeling of origin, labels and etc are overlapping. Hence, the handling of subjects who make the false origin of goods is facing many difficulties. Specifically, the handling of offenders requires competent authorities to seize goods at their manufacturing places. Moreover, the authorized owner must admit that the seized goods as counterfeit and imitation. In fact, the assessment of goods origin of a large amount of goods under the guise of Vietnamese goods is not easy.

For example, in 2016, Sai Gon Customs Branch Zone I detected 1 shipment including 6 containers of ceramic tiles imported from China but labeled “made in Vietnam”. The shipment was carried out Customs procedures at Cat Lai Port by H.T Co., Ltd. At the end of 2016, Sai Gon Customs Branch Zone III detected 7 containers of ceramic tiles imported from China but labeled “made in Viet Nam”, ROYALGRES PORCELLANATO brand, manufactured in My Xuan A Industrial Park, Tan Thanh District, Ba Ria - Vung Tau Province.

In order to clarify the act of counterfeit origin, the Customs has to send Customs officers to the manufacturer of the ceramic tiles above for verification. According to the verification at Hoang Gia Ceramic Tile Joint Stock Company with the address and information of the imported products above, the company confirmed that it had no business relationship with H.T Co., Ltd and did not export any ROYALGRES ceramic tiles to China.

According to the physical inspection and verification of competent authorities, Sai Gon Customs Branch Zone I determined that H.T Co., Ltd imported goods with false instructions on origin and manufacturing and packing places on the label and packages was fined 80 million VND for administrative violation and was forced to re-export the infringing goods and was not punished for production and trading of counterfeit goods.

In addition, in the domestic market, the competent authorities detected and seized Chinese goods were labeled “made in Vietnam”. From the beginning of 2017 to now, the Market management agencies of Ho Chi Minh City inspected and detected and seized nearly 4 tons of beer bottle caps, skin care cream; over 350,000 labels, packages and beer empty bottles of all trademarks, 28,401 units of fake Chanel, Nike, CK, Adidas, LV, Tommy, Lacoste clothes, glasses, shoes and handbags.

In fact, Chinese goods under the guise of Vietnamese goods are a concerned problem, causing anxiety for consumers.
