11 people prosecuted for making fake inspection certificates in the smuggling case of 1,282 containers

The HCM City People's Procuracy has just approved Decisions to prosecute and investigate 11 suspects related to the smuggling of 1,282 containers of second-hand machinery and equipment from Japan, Taiwan to Vietnam for consumption, led by a former Ho Chi Minh City police officer.

The 11 defendants are leaders and employees of Dai Minh Viet Inspection Company, including Duong Manh Linh, Tran Xuan Duan, Dinh Van Hien, Mai Duc Tai, Cao Dang Minh, Duong Quoc Hoa, Tran Dinh Hung, Vo Hoai Duc, Tran Tan Long, Dinh Quang Trieu and Trinh Hoang Phuoc.

The above defendants were prosecuted for the crime of "Smuggling" under Article 188 of the 2015 Penal Code.

According to the initial investigation, on May 24, 2021, the Economic Police Division of the HCM City Police Department worked with the Saigon Port Zone 1 Customs Branch (HCMC Customs Department) to inspect and detect six containers of second-hand machinery and equipment imported from Japan and Taiwan.

Through investigation, the police agency determined that Hoang Duy Tien, an officer of the Anti-Smuggling Team under the Economic Police Department of the HCM City Public Security, was the mastermind who established dozens of legal entities, named on customs declarations to import used goods to Vietnam with an amount of 1,282 containers of contraband goods with a taxable value of VND192 billion.

In early June 2021, the investigation agency prosecuted Hoang Duy Tien and four accomplices. During the investigation process, the police agency determined that, in addition to the four defendants, there were also 11 defendants of Dai Minh Viet Inspection Company.

According to regulations, used machinery imported to Vietnam must have a certificate of inspection. The defendants of Dai Minh Viet Assessment Company made 1,121 fake inspection certificates to Hoang Duy Tien to abet smuggling.

The case is being expanded by the Investigation Agency.
