According to the form of notice on the import of discarded materials for inspection and clearance, issued in Appendix 12, Circular No. 41/2015 / TT-BTNMT on the import of discarded materials used as raw materials for production, The Department of Pollution Control under the Ministry of Natural Resources and Environment or the Department of Natural Resources and Environment are the agencies issuing the notice legally. However, in practice, some enterprises when carrying out Customs procedures have presented the notice of imported scraps for inspections and clearance issued by the Environmental Protection Branch in Binh Duong province.
The Department of Natural Resources and Environment in Binh Duong province authorizes the Environmental Protection Branch to issue the notice for imported discarded materials for inspections and clearance of establishments which are certified by the Department of Natural Resources and Environment in importing materials for production.
Recently, in the document guiding this issue, the General Department of Vietnam Customs said that at present, the Ministry of Natural Resources and Environment had no guidance on the authorization of the Branch of Environmental Protection under the Department of Natural Resources and Environment to issue a notice for imported goods for inspections and Customs clearance. Therefore, the Customs Department of Ho Chi Minh City has no basis for settlement for these businesses.
These problems have been reported by the Customs Department of Ho Chi Minh City to the General Department of Vietnam Customs to provide guidance to create favorable conditions for businesses, avoid causing congestion at the port and at the same time ensure the management of scrap import.
According to the reporter, when scraps were imported massively at Cat Lai port and other port borders, the leaders of the Customs Department of Ho Chi Minh City directed the Customs departments of border checkpoints to promote inspections, supervision and carry out procedures strictly according to regulations on imported scraps.
Accordingly, when carrying out the procedures, the Customs must thoroughly examine the dossiers, licenses, import conditions, quantity, weight, type of import and export, names and codes. The deduction of the license must be in accordance with regulations, and the leaders of the department must sign on the form of deduction.

The Customs shall organize the verification of licenses and notices for imported discarded materials if there are any doubts to comply with regulations on handling of outstanding goods under Circular No. 203/2014 / TT-BTC of the Ministry of Finance and set up a task force to monitor waste material and disposal of unsold inventories.
