VCN- In the recent time, many e-newspapers have sated about the situation of Vietnamese citizens who will be permitted to play in the casino. On November 3, 2017, the Ministry of Finance has released the official information.

According to the Ministry, the pilot permission for Vietnamese citizen to play in a casino is stipulated in the Government’s Decree 03/2017/ND-CP dated 16 January 2017 on casino business. Specifically, Articles 12 Decree 03/2017/ND-CP stipulates that “The pilot permission for Vietnamese citizens to play in casinos shall be conducted at casino-included entertainment complexes at places satisfying the requirements in this Decree and approved by the competent authorities”.

Besides, Clause 3 Article 12 of the Decree 03/2017/ND-CP also specifies conditions for Vietnamese citizen to play in casinos as follows: He/she is at least 21-year-olds and fully capable of civil acts according to Vietnam’s laws (having monthly income at least 10 million vnd per month or being subject to at least grade- 3 Income Tax); Player must buy a casino entrance ticket (the price of the ticket shall be 1 million VND /24 continuous hours/person or 25 million VND /month/person) and he/she is not a person whose parents, adoptive parents, spouse, or natural child requests the casino-operating enterprise to prevent him/her from playing games in the casino. At the same time, the Government has assigned the Ministry of Finance to provide guidance on dossier proving the financial capacity of player.

On 5th October 2017, the Ministry of Finance promulgated Circular 102/2017/TT-BTC (taking effect from 1st December 2017) guiding a number of articles in Decree 03, in which specifies on dossiers proving the financial capacity of Vietnamese citizen playing in the casino.

Vietnamese citizen want to play in a casino needs to have one of the dossiers as follows: Documents proving that being subject to at least grade-3 Income Tax as prescribed in the Law on Personal Income Tax; Certified copy declaration of Personal Income Tax finalized by the Tax authority or document certified by the Tax authority for fulfill tax payment of the player, proving that the player subject to at least grade-3 Income Tax under provisions in the Law on Personal Income Tax within 1 year before playing in casino; Document proving monthly income at least 10 million VND per month.

The certified copy of documents proving monthly income and wage sheet or decision for paying wage of the agency where the player is working in the latest 3 months from the date of playing, in which the monthly income at least 10 million VND per month is shown; Certified copy of valid contract of house and property leasing as per regulation of the law, in which the total amount of monthly leasing at least 10 million VND per month is shown; Certified copy of bank savings accounts and statement of bank deposit account of the player with a term at least 1 year and monthly interest at least 10 million VND or other documents.

If one of above dossiers does not prove the income of the player at 10 million VND per month, the player can submit other dossiers to prove the monthly total income of 10 million VND.

Hence, after competent agency approves the specific pilot place under regulations in Decree 03/2017/ND-CP, Vietnamese citizen must satisfy conditions as per above provisions of the law (age, civil acts, relatives, and financial capacity).
