Import of cosmetics for non- commercial purposes

In the response document sent to the General Department of Customs regarding regulations of importing cosmetics for non- commercial purposes, the Drug Administration of Vietnam (Ministry of Health) said that: organizations and individuals that import cosmetics for research and testing have to send the orders of such import to the Drug Administration of Vietnam. The maximum sample for each product is 10.
The imported order of cosmetics for research and testing is made in 3 copies. After being approved, 2 copies are stored in the Drug Administration of Vietnam, 1 sent to the unit. The copy sent to unit will be stamped "copy sent to the enterprise" in order to present to Customs authorities when doing Customs clearance procedures.
The imported cosmetic products for research and testing must be used for proper purposes, not allowed to be sold in the market.
According to the Drug Administration of Vietnam, organizations and individuals that register cosmetics as gifts should do import procedures at the Customs agency as prescribed in the regulation. Also, the total value of each acquisition should not exceed the norms of goods exempt under the current regulations.
Samples of imported cosmetics as gifts are not allowed to be sold in the market place.
In the case where organizations and individuals import cosmetics for display at trade fairs, exhibitions and cases of temporary import and re-export, they have to do procedures for in accordance with current regulations of the Ministry of Industry and Trade.
According to the Drug Administration of Vietnam, the import of cosmetics for non- commercial purposes such as gifts and samples are specified in Clause 2, Article 35 of Circular 06/2011/TT-BYT of the Ministry of Health on management of cosmetics.
