Could you evaluate the responsibility of the local government, functional forces about the situation of taking advantage of e-commerce business to trade smuggled and counterfeit goods?
In recent years, the competent forces have coordinated in discovering many cases of taking advantage of e-commerce to trade in smuggled, counterfeit and unknown origin goods on a large scale. A typical example is the warehouse inspection case in Lao Cai. According to information from the General Department of Market Management, the above warehouse has been in operation since 2018, with a very large number of employees operating at the warehouse, a large amount of goods entering and leaving.
Every day, many orders are received by shipping companies to deliver to customers. When the central forces coordinated the inspection (July 2020), the local management units knew the activities of the suspects.
This shows that the local management of the government and local forces lacks a sense of responsibility, it has not been close enough and fully implemented the assigned functions and tasks.
Regarding the fight against smuggling, trade fraud and counterfeiting in e-commerce business, what solutions have been proposedby the Standing Office of the National Steering Committee 389?
Since 2018, the Standing Officehas identified the tricks of the suspects who abuse e-commerce to trade in smuggled goods, banned goods, counterfeit goods, and goods infringing intellectual property rights.The Standing Office actively organized many seminars, coordinated with functional forces to advise on building plans of the National 389 Steering Committee on strengthening anti-smuggling, commercial fraud and counterfeit items in e-commerce activities. Currently, the Standing Office is completing a draft plan to submit to the leaders of the Board for a decision.
At the same time, implementing the direction of the Standing Deputy Prime Minister Truong Hoa Binh, Head of the National Steering Committee 389, the Standing Office is cooperating with the Steering Committee 389 of Hanoi to develop a coordination plan inthe fight against smuggling, commercial fraud and counterfeiting in e-commerce activities in Hanoi.
In order to improve the effectiveness of the fight against smuggling, trade fraud and counterfeit goods in e-commerce activities, what should ministries and agencies do?
I think it is necessary to have the active participation of ministries and branches such as the Ministry of Industry and Trade to direct relevant functional units under the ministry to review and classify the list of websites, e-commerce applications, commodity groups and violations to properly assess the current situation; conducting inspection and examination nationwide for organizations and individuals.
The Ministry of Information and Communications uses professional measures and technical solutions to strengthen the review, inspection and examination to strictly handle acts of taking advantage of e-commerce to violate the laws in the state management fields of the ministry; inspecting and supervising the use of implementation of suspension, temporarysuspension and revoking licenses of websites, social networks, Vietnamese national domain names ".vn", other domain names organized by national organizations allocated to Vietnam and IP addresses for websites and social networks used to violate the law in e-commerce activities.
The Ministry of Public Security direct the units to proactively detect, verify and clarify acts of violations by organizations and individuals; organizing the fight against gangs, focusing on investigation, conclusion, strictly handling the conspirators, leaders, complicated cases, prominent in using e-commerce to violate the law.
The Ministry of Finance directs the General Department of Customs to take measures to detect and promptly prevent, investigate and handle smuggling, commercial fraud, and counterfeit goods in e-commerce activities; directing the General Department of Taxation to strengthen tax administration for e-commerce business.
