The number of violations decreased sharply

From the beginning of the year until now, in the customs management area of Dong Nai Customs Department, export and import business activities of enterprises have been significantly affected by complex fluctuations of the global and domestic economic situation.

In addition to solutions to reform administrative procedures and facilitate production and business activities, import and export of enterprises, Dong Nai Customs Department has proactively analyzed and evaluated the actual operating situation of import-export enterprises in the management area and has controlled exchange, purchase, and transportation of goods subject to customs management, especially activities of exchange, purchase, and transportation of goods from non-tariff zones to the inland. At the same time, strengthen control over key groups of import and export goods such as banned goods, conditional goods, goods with high tax rates and large values; Tax-free and non-taxable goods such as machinery and equipment on the duty-free list, processed goods, export production, bonded warehouse goods, goods of export processing enterprises, etc.

In particular, activities of exchanging information, disseminating legal policies, and raising awareness and a sense of legal compliance for businesses are carried out regularly and continuously through many new and convenient forms for businesses. Thanks to that, the compliance with customs laws by businesses in the area is relatively good and increasingly improving.

Specifically, from the beginning of the year until now, the number of cases sanctioned for administrative violations at the unit recorded a decrease of 28% compared to the same period in 2022, at 471 cases with a total fine of 22.6 billion VND. The main violations were incorrect declarations during the implementation of customs administrative procedures and did not result in acts of smuggling or trade fraud.

Typically, M. VN Company Limited was fined nearly 562 million VND for violating regulations on preparing final settlement reports that were not consistent with books, accounting documents, and customs declarations; Violations of regulations on the management of raw materials and supplies for export production led to the difference between actual inventory shortages and accounting documents, accounting books, and customs records for exported and imported goods. Similarly, R. (Vietnam) Co., Ltd. was fined nearly 732 million VND for incorrectly declaring the import tax exemption code and the object code not subject to VAT in on-site import declarations signed by the company in the sale contract for export production with foreign organizations which have no presence in Vietnam, etc.

Strengthen coordination and firmly grasp the area

According to Mr. Pham Quoc Hung, Deputy Director of Dong Nai Customs Department, it is forecasted that from now until the end of the year, production and business activities of enterprises will continue to face difficulties due to the consequences of the COVID-19 epidemic and its impact. The impact of inflation and rising interest rates affects the global economy, orders are cut. This leads to the risk that some businesses may stop operating, even flee, go missing, or go bankrupt.

Faced with that situation, Dong Nai Customs Department continues to thoroughly grasp the role, position, and functions of the Customs agency in the process of performing tasks according to regulations. At the same time, firmly grasp the scope of the area presided over by the Customs agency, and take responsibility for inspecting, supervising, and handling violations of customs laws; The Customs department is responsible for coordinating with relevant functional forces based on cases, projects, and topics approved by leaders of competent authorities.

Dong Nai Customs Department will strengthen coordination with functional forces in the area such as the Police, Procuracy, Industrial Park Management Board, Tax, and Border Guard in implementing area management activities. Thereby, firmly grasping the operating situation of businesses, especially the group of key and high-risk businesses. Classify and group businesses to have appropriate and effective plans and solutions for control and management, to prevent businesses from running away or going missing; Do not let the act of transporting and consuming raw materials, supplies, machinery, and equipment for the wrong purpose in order to gain illegal benefits, causing loss of state budget revenue.

In the fight against illegal trafficking and transportation of drugs and precursors, especially precursors imported as raw materials for processing and export production, Dong Nai Customs Department will strengthen management to prevent the use of precursor chemicals for improper import purposes. Simultaneously, strengthen professional drug control measures, coordinate with local forces and anti-drug smuggling forces of the General Department of Customs to exchange information, forecast the situation, and be proactive in identifying signs and violations promptly and have effective plans to fight and control them.
