Regulations on public operations are standards of Vietnam Customs

VCN – On 2 February, 2017, the General Department of Vietnam Customs issued Decision No. 188/QD-GDC promulgating "Regulations on public operations of Vietnam Customs." According to the Deputy Director of the Department of Organization and Personnel of the General Department of Customs, Nguyen Duy Thong, the regulations are standards on the public operations of Vietnam Customs.

Recently, Customs has issued many legal documents promulgating operational regulations, please tell us, why we need to add " Regulations on public operations of Vietnam Customs?

Until now, the General Department of Customs has issued many documents providing contents related to rules and disciplines in the public operations of Customs civil servants, officials and officers, however, the contents in the regulations on Customs public operations are stipulated in many documents and issued in many stages. Besides, many regulations are not clear and not specific, and some documents are no longer suitable with Customs operations in the present time, they are limited in publication, study and implementation.

Thus, to build a common standard and a unified document on public operations in Customs under the direction of the Director General Nguyen Van Can, the Department of Personnel and Organization has prepared “Regulations on public operations of Vietnam Customs” which stipulate the principles and responsibilities in the public operations of Vietnam Customs including: regulations on responsibilities, duties, working relationship, working regime, business, meeting, training and security; and regulations on uniform, posture, style of work, internal regulations and workplace hygiene of individuals and units in the organizational system of Vietnam Customs.

The Regulations have been widely consulted throughout Customs, and approved by the Director General to apply for subordinates of the General Department of Customs, and civil servants, officials and contract employees in Customs. In particular, the Regulations require Customs officers to interpret the assigned functions, duties and powers; and have a sense of responsibility, and sense of organizational discipline in accordance with the scope of functions and duties, powers; and strictly abide by the unit’s internal regulations

The new Regulations replace a series of decisions: Decision 1395/QD-TCHQ on 10 principles of Vietnam Customs; Decision 1691/TCHQ/QD-TCCB on regulations on Customs uniform; Decision 557/QD-TCHQ on behavior principles of civil servants, officials and contract employees of Customs; Decision 2628/QD-GDC on Customs rituals and traditional ceremony organization and Decision 1951/QD-TCHQ on regulations on compliance of violation settlement in the observance of administrative discipline and principles for civil servants, officials and contract employees in units in the General Department of Customs.

In particular, for provisions on duty performance in directing and implementing the directions, the Regulations stipulate that the issue of the directions must follow the hierarchical order of leaders in the unit from superiors to subordinates. The directions must be clear and specific, and the leaders issuing directions must take charge of urging and monitoring implementation. In case of necessity, superior leaders may directly assign implementing subordinates, but then must report to the leaders who manage the implementing subordinates.

For "Regulations of public operations of Vietnam Customs" to be implemented effectively, how will Customs deploy and supervise the implementation, Sir?

The compliance of the Regulations on public operations is one of the criteria for monthly and annual evaluation and classification of Customs officers, and for the consideration of the periodic emulation and commendation. Customs units and officers violating the Regulations shall be handled in accordance with provisions of the law and the General Department of Customs. The Head and Deputy levels in the units which have officers violating the Regulations also consider their responsibilities under the regulations of the Ministry and Finance and the General Department of Customs.

As for supervision of implementation, the Department of Personnel and Organization will direct and coordinate with the Inspectorate to inspect and summarize the implementation of the Regulations in Customs in order to support the consideration for periodic emulation, commendation, evaluation and classification of officers, as well as to propose to handle violation cases.
