Refuse to predetermine the code by providing more than one item mark

It is acknowledged that Aqua Vietnam Electrical Appliances Vietnam., Co Ltd submitted application for code predetermination for item “Damper” (wind control of bridge). At section B8 (mark, code, type), the company provided item code 3715G-NSBC003-VIETNAM, but the provided documents and invoices showed that the item code was NSBC003ZA1
Besides, according to the explanation, the Company provided more than 1 product mark in the application for code predetermination. This did not comply with the provision in Paragraph 1 of Article 24 of Decree No. 08/2015/ND-CP on conditions for predetermination of code, origin, Customs value on each application corresponding to one product with one code only.
Therefore, the information provided by the company was not consistent with the attached technical documents, the General Department of Customs has no basis to determine the code under the Company’s application.

It is reported that another case was refused to predetermine the code by the General Department of Customs due to the application did not fulfill all the criteria and the volume of goods as sample was not enough to carry out the analysis and classification of goods. Or provided goods and attached documents were not kept in suitable conditions and goods were damaged. These are reminders for enterprises which intend to ask for code predetermination.
