Adhere to the Law on Product and Goods Quality

According to the drafting committee, Chapter II stipulates the order and procedures for state inspection of quality for imported goods, specifying each method of inspection. The basis for construction to adhere to the regulation "Imported goods of group 2 must be announced and certified as technical-regulation conformity according to corresponding technical regulations" of the Law on Product and Goods Quality.

Section 1 of this Chapter specifies regulations on goods subject to regulation conformity announcement, order and procedures for registration of regulation conformity announcement, granting of registration number of regulation conformity announcement.

This is the most important basis so that the inspection of imported goods will be carried out according to the order and procedures from strict, to normal, to reduced, even exempt from quality inspection, applicable to goods for which regulation conformity has been announced and imported goods that have not yet been announced regulation conformity.

Particularly for imported vehicles, components and spare parts that are in group 2 goods according to the provisions of the Law on Product and Goods Quality, they are specific goods, so the order and procedures for state inspection on goods. The quality of imported vehicles, components and spare parts is specified in a separate item.

With the principle of inheriting regulations and good practices that have been implemented for goods in the field of the Ministry of Transport; the inspection agency for group 2 goods under the management responsibility of the Ministry of Transport is Vietnam Register; the entire order and procedures carried out through the National Single Window Portal basically keep the current regulations; the inspection methods for vehicles specified in the draft Decree and current regulations are the same, including: tight inspection and probability test.

Throughout the content of the chapter stipulating the order and procedures for state inspection of quality for imported goods, there are outstanding points.

In particular, a notable point is that enterprises can register for inspection agencies, select a designated testing organization for testing (for goods subject to the case that samples must be taken for testing).

The above regulation will help enterprises take the initiative in registering an inspection agency assigned/designated by the line ministry or by the Customs to perform state inspection of quality according to inspection methods.

This content has institutionalized the "inspection agency" according to the content of the new model of quality inspection and food safety inspection for imported goods in Decision 38/QD-TTg of the Prime Minister.

Simple test registration records

In addition, the state inspection process for quality in the draft Decree also cuts and simplifies inspection registration documents.

The draft Decree stipulates that the application for registration for quality inspection includes the following three documents: The registration for quality inspection of imported goods according to the information criteria promulgated together with the Decree; Commercial invoices (photocopies), photos of goods labels or complete designs of goods labels in the form of electronic data for imported goods must have labels according to the provisions of law on goods labeling (photocopy).

Compared with the provisions of Decree 74/2018/ND-CP, Decree 154/2018/ND-CP, the draft Decree has cut six of 10 documents that organizations and individuals must submit and present when implementing quality checks. The reduced vouchers are those currently specified as “if any”. The reduction of these documents helps to simplify and transparent the records, avoiding arbitrariness in the implementation process.

For the case of applying the reduced inspection method: after searching on the National Single Window Portal, if an organization or individual determines that their imported goods are eligible for the reduction method, they shall declare their registration code of conformity of goods with the same name, HS code, utility, brand, type, technical characteristics, production facility, country of origin on the customs declaration. The customs authority shall check and compare the application for registration of code conformity announcement on the National Single Window with the import dossier to decide on the customs clearance of goods according to regulations.

The above provisions are intended to create favorable conditions for organizations and individuals to import; cut records and documents, reduce costs for businesses.

Accordingly, organizations and individuals do not have to carry out procedures and submit dossiers for registration of quality inspection, but only need to declare the registration code of the declaration of conformity of goods on the customs declaration to be granted customs clearance. For 5% of goods subject to inspection, the customs electronic data processing system automatically selects the shipment at random and responds to the importing organization or individual.

This content institutionalized reform 3 in Decision 38/QD-TTg of the Prime Minister.

In addition, in the order and procedures for state inspection of quality for imported goods, there are also many regulations simplifying the order and procedures for registration of announcement of conformity; regulate the order of inspection procedures by item to reduce the number of shipments subject to inspection, simplify inspection procedures; or regulations to fully apply three methods of tight inspection, normal inspection and reduced inspection; at the same time reforming the order and procedures for state quality inspection of imported vehicles, components and spare parts.
